As used in this chapter, the following terms shall have the meanings indicated:
AMUSEMENT DEVICE
Any automatic, mechanical or electronic amusement device for skill or entertainment, whether coin-operated or not, including but not limited to pinball machines, video games, bagatelle, console, cathode-ray tube game machine or similar devices that use a display screen for points, lines or dots of light that can be manipulated to stimulate games or other types of entertainment.
It shall be unlawful to have or possess or to operate for gain or amusement in the Town of Dover any amusement device as defined herein, without first obtaining a license therefor, and provided that all conditions set forth in § 109-3 herein are met.
The Town Clerk, upon authorization by the Mayor and Board of Aldermen of the Town of Dover, is hereby authorized to issue such licenses upon the following terms and conditions:
A. 
The license fee shall be $180 per year for each amusement device, with each license expiring on May 31 of each year.

B. 
The license shall be prominently displayed by attaching the same on each device.
C. 
Not more than two amusement device licenses shall be issued to any one owner, tenant or operator, nor shall more than two licenses be issued for any one establishment.
D. 
The placement of each and every amusement game within an establishment must have the approval of the Chief of Police of the Town of Dover.
E. 
No amusement device shall be installed within 200 feet of any school or church.

A. 
No amusement device shall be utilized for games of chance, prizes, payoffs or gambling, nor shall there be any gambling in the playing or in the operation of the same.
B. 
No one under the age of 18 shall be permitted to operate the same where said machine is located in or on premises from which there is sold or consumed alcoholic beverages.
C. 
No one under the age of 18 shall be permitted to operate said amusement devices of any nature during the hours of 7:30 a.m. to 3:00 p.m., Monday through Friday, from September 1 of each year until June 30 of each year, except during those days that the public schools of Dover are in recess or on vacation.

Anyone convicted of a violation of this chapter §§ 109-1 through 109-4 shall be subject to one or more of the following: a fine not exceeding the sum of $1,000, imprisonment for a term not to exceed 90 days or a period of community service not exceeding 90 days, for each violation.

To set up, maintain, or permit, suffer or allow to be set up, kept or maintained in any house or other premises or place any device or game of chance for the purpose of gaming, or engage in any game of chance either as banker, player, dealer or otherwise for the purpose of gaming, except those bona fide qualified organizations which, pursuant to N.J.S.A. 5:8-24 et seq. (Bingo Licensing Law), and N.J.S.A. 5:8-50 et seq. (Raffles Licensing Law), may conduct games of chance on any day, including Sunday, upon application to and approval by the Municipal Clerk pursuant to the rules and regulations of the New Jersey Legalized Games of Chance Control Commission. In the event that the Municipal Clerk or Deputy Municipal Clerk are unavailable or unable to review the application, the Chief of Police shall approve or disapprove of the application pursuant to the rules and regulations of the New Jersey Legalized Games of Chance Control Commission.
