The sleeping accommodations of a motel shall be rented only for the
use of transient occupants and shall not be used or occupied on any permanent
basis and no such occupant shall be deemed to be a resident therein. Permanent
residency at motels is prohibited.
As used in this article, the following terms shall have the meanings
indicated:
Any occupancy of a motel unit other than transient.
Occupancy of a motel unit for not more than 30 consecutive calendar
days or not more than 60 days during any ninety-day period. Occupancy is not
deemed to have been interrupted by changing rooms or by an interruption in
occupancy of less than 30 days.
The person physically occupying a motel unit and having a principal
residence elsewhere.
Permanent residency of any motel unit is prohibited and is a violation
of this article, however, nothing in this article shall apply to an employee
of the motel required to live on the property.
A.Â
Every motel shall maintain on the premises a complete
register of all rentals therein which lists, by unit number, the true name
and permanent address of each person to occupy that unit, the date of arrival
and the date when the occupant or occupants of each unit quit and surrendered
the same. Registers shall be signed by the person renting the unit.
B.Â
No person shall occupy and no motel shall permit any
person to occupy any motel unit unless every adult who is to occupy the motel
unit shall furnish satisfactory identification. Satisfactory identification
shall consist of either a valid driver's license or other government-issued
photo identification. The motel shall maintain a photocopy of the identification
produced. No motel unit shall be rented to any person under the age of 18
years.

The register and photocopies of identification shall
be kept and preserved by the motel for three years and shall be available
upon request at any time to Borough Code Enforcement Officer.
The owner or operator of any motel found to be in violation of this
article will be subject to the following penalties:
A.Â
First offense: not less than $100 and not more than $1,000
per day for each and every day of violation.
B.Â
Second offense: not less than $100 and not more than
$1,500 per day for each and every day of violation.
C.Â
Third offense: not less than $500 and not more than $2,000
per day for each and every day of violation and revocation of the motel's
mercantile license for 60 days.
D.Â
Each day that a violation continues is considered a separate
and specific violation.
