A. 
The Township of Evesham, having adopted a Faulkner Act form of government in which the Township Manager is the chief administrative officer of the municipality and the Township Council is the legislative body and it being provided that every municipality must establish a local Board of Health or some other board, body or officer who may exercise the same functions pursuant to N.J.S.A. 26:3-1, there is hereby established a Department of Health, the head of which shall be the Director of Health, who shall be the Township Manager serving without additional compensation, unless and until he shall delegate his authority by regulation duly enacted to another person or persons who shall be so qualified to act.
B. 
The Director of Health shall carry out all the administrative functions of said Department, which shall include but not be limited to the issuance of food handlers' licenses, conceptual approval of septic systems' applications and all other duties of a local Board of Health as are set forth more specifically in N.J.S.A. 26:3-1 et seq. and in regulations promulgated by the State Commissioner of Health.
C. 
Nothing hereinbefore or hereinafter stated shall in any way supersede or revoke the power of the Township Council as the sole municipal authority to pass, alter or amend ordinances in regard to the public health of the Township.
D. 
The Director of Health shall have the power to make such necessary rules and regulations to implement any ordinances affecting the public health which the Township Council shall have passed, altered or amended, provided that, before such regulations shall take effect, they must first be published once in the official Township newspaper, posted in a place conspicuous to the residents of the Township and remain on file at all times in the office of the Township Clerk. Copies shall be made available to those persons who shall request same from the Clerk.
E. 
The Director of Health may recommend and request that the Township Council pass, alter or amend ordinances in regard to the public health and enter into agreements with the Burlington County Board of Chosen Freeholders or any other county or state agency for the purpose of furnishing health services to the Township as he may deem necessary and expedient.

There shall be a Township Physician of the Township of Evesham, to be appointed by the Township Manager, who shall be a person duly licensed by the State Board of Medical Examiners of New Jersey to practice medicine and surgery within the state and who shall perform all medical services required to be performed by or on behalf of the Township, including the Police Department hereof. The salary of the Township Physician shall be based upon a retainer or such reasonable compensation payable on the basis of services actually performed.
There shall be a Registrar of Vital Statistics within the Department of Health, who shall be appointed by the Manager. Said Registrar of Vital Statistics shall have charge of the administrative duties involved in obtaining reports of and recording births, marriages and deaths in the municipality, together with such related work as may be required in accordance with general law and ordinances of the municipality.

There shall be a Deputy Registrar of Vital Statistics and no more than two Alternate Registrars of Vital Statistics who shall be appointed by the Township Manager. Said Deputy and Alternate(s) shall have all the powers and shall perform all the duties of the Registrar of Vital Statistics during such times and for such periods as the Registrar of Vital Statistics shall be absent or otherwise unavailable.
