It shall be unlawful for any person, corporation or other entity to abandon a motor vehicle on or along any highway or other public property in the Borough of Haledon. A vehicle which has remained on or along any highway or other public property for a period of more than 48 hours or for any period without current license plates shall be presumed to be an abandoned motor vehicle. Vehicles used or to be used in a construction operation or maintenance of a public utility facility and which are left in a manner which does not interfere with the normal movement of traffic shall not be considered abandoned vehicles for the purposes of this section.
The Police Department of the Borough of Haledon is hereby authorized to remove a vehicle that has remained on or along any highway or other public property in excess of 48 hours to a garage designated by the Borough.
A. 
Immediately after a vehicle is so removed, the Chief of Police or such member acting for him shall notify the registered and legal owner in writing, by personal service or by registered mail at the last known address of the owner, of the removal of such vehicle and the reason for the same and the location of the vehicle.
B. 
Such vehicle shall be retained and impounded. Said vehicle shall be released to the owner upon payment of the reasonable cost of such taking and removal, together with such storage charges as may be tendered by storing facilities for each and every day such vehicle is retained and impounded. In default of such payment, said vehicle may be disposed of according to law.
The person, corporation or other entity who or which violates this chapter shall be subject, for the first offense, to a fine of not less than $100 no more than $500, and their driver's license and/or registration may be suspended or revoked by the Director of Motor Vehicles for not more than two years. For any subsequent violation, there shall be a fine of not less than $500 nor more than $1,000 and their license, driving privileges or registration may be suspended or revoked for a period of not more than five years.
Conviction by the Municipal Court shall not bar or prevent the institution of other proceedings against the owner or person in charge of a vehicle who is in violation of this chapter of the Code of the Borough of Haledon.
