[HISTORY: Adopted by the Township Committee of the Township of Hanover 12-9-1976 by Ord. No. 26-76. Amendments noted where applicable.]
Pursuant to the provisions of Section 5 of the Municipal Utilities Authorities Law of the State of New Jersey (Laws of 1957, Chapter 183, as amended and supplemented),[1] there is hereby created a public body corporate and politic under the name and style of the "Southeast Morris County Municipal Utilities Authority."

The Southeast Morris County Municipal Utilities Authority (the "Authority") is and shall be an agency and instrumentality of the Township of Hanover in the County of Morris, the Township of Morris in the County of Morris, the Borough of Morris Plains and the Town of Morristown, all in the County of Morris (the "Creating Municipalities"), created by parallel ordinances duly adopted by their governing bodies, and shall be an authority as contemplated and provided for by said Municipal Utilities Authorities Law[1] and shall have and exercise all of the powers and perform all of the duties provided for by said Municipal Utilities Authorities Law and any other statutes heretofore or hereafter enacted and applicable thereto.[2]

Editor's Note: Pursuant to Ord. No. 29-76, adopted 12-21-1976, as amended 12-8-1977 by Ord. No. 27-77, the Township of Hanover entered into a contract with the Southeast Morris County Municipal Utilities Authority providing for and relating to the supply and distribution of water. Said ordinances and the contract authorized thereby are on file in the Clerk's office.
A. 
From its creation until February 1, 1981, the Authority shall consist of six members, three of whom shall be appointed by the governing body of the Town of Morristown, and one of whom shall be appointed by each of the governing bodies of the other creating municipalities.
B. 
From and after February 1, 1981, the Authority shall consist of eight members, two of whom shall be appointed by each of the creating municipalities.

For the calendar year 2021 and thereafter, members of the Authority shall receive as compensation for their services the sum of $2,200 per annum.

Editor's Note: This ordinance provided that it shall take effect after publication by title after its final passage as provided by law, but shall be of no further force or effect after September 1, 2021, unless on or before said date a parallel ordinance shall have been adopted by the governing body of each of the creating municipalities.
A copy of this chapter duly certified by the Clerk of the Township of Hanover shall forthwith be filed by said Clerk in the office of the Secretary of State of the State of New Jersey.
