[HISTORY: Adopted by the Township Committee of the Township of Independence 10-8-1991 by Ord. No. 91-8 (Ch. 124 of the 1984 Code). Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
DRINKING
Consuming or holding an open or partly consumed container of alcoholic beverages of any nature, or having in one's possession an open or partly consumed container of alcoholic beverages of any nature.
A. 
No person shall drink any alcoholic beverage in any public place nor hold or possess any open container of partly consumed container of alcoholic beverage of any nature. This, however, shall not apply to a person drinking alcoholic beverages in any establishment or within which such consumption is permitted pursuant to a valid retail plenary alcoholic beverage consumption license, provided that such activity is conducted in accordance with the ordinances of the Township of Independence and provided further that such activity is in accordance with the rules and regulations as prescribed by the Department of Alcoholic Beverage Control of the State of New Jersey.
B. 
The prohibition of drinking alcoholic beverages as described herein shall not apply where the drinking of alcoholic beverages is specifically permitted by resolution of the Mayor and Township Committee, provided that the drinking of alcoholic beverages is conducted as provided in such resolution with regard to the area it occurs in, the dates and times permitted and the manner and nature of the alcoholic beverage permitted to be consumed. Upon passage of such a resolution by the Mayor and Township Committee, a permit shall be issued, which permit shall specify the name of the person, the firm or corporation to whom the permit is issued, the dates and times for which the permit has been issued and identification of the location of the special event or events for which the permit has been issued, the nature of the alcoholic beverage permitted and the manner of distribution of the alcoholic beverage for consumption. Such permit shall be subject, however, to approval by the Department of Alcoholic Beverage Control of the State of New Jersey, where such approval is necessary, in accordance with the laws of the State of New Jersey and rules and regulations promulgated in accordance therewith.
No person under the influence of intoxicating liquor shall loiter or create a disturbance in any public street or public or quasi-public place or in any public conveyance, or upon any private property not his own, without the permission of the owner or other person having authority to grant such permission.
A. 
No person shall intentionally appear on any street or other public place in a state of nudity, or make any indecent exposure of his or her person, or commit or cause to be committed or participate in the commission of any lewd or indecent act or behavior.
B. 
No person shall disrobe in any automobile, truck or vehicle while the same is upon any street, public parking place, public park or public place or ground.
C. 
No person shall bathe or swim in the state of nudity or be found in the state of nudity at any public lake, pool, pond or river or in any lake, pool, pond or river where the public is invited or permitted.
No persons, two or more in number, shall fight together or commit or attempt to commit assaults and batteries upon one another, either in a public or private place, or be present, aid assist or abet the same.
No person shall willfully engage in any fight, assault, quarrel, brawl, battery or altercation, nor shall any person participate in or incite by overt act or acts any disturbance or riot, or any unruly, boisterous, noisy, unlawful or disorderly assemblage constituting a breach or disturbance of the peace.
No person shall cast, shoot or throw anything at, against or into any vehicle, railroad car, airplane or other facility of transportation or shall place any stick, stone or other substance upon any railroad track with intent to injure, detrack or otherwise interfere with any locomotive, car or other vehicle passing thereon, or the crew or passengers thereon.
No person shall place or throw or permit the depositing of any stone, sticks, glass, snow or ice, or any hard, dangerous or offensive substance, upon any street or other public thoroughfare, nor shall any person throw any such object or substance at, upon or against any person, vehicle or transportation, building or other structure.
No person shall unnecessarily obstruct any street or public place with any kind of vehicle or with any box or boxes, lumber or wood and shall not prevent persons who are building from occupying (until notified by any Independence Township official to cease such occupancy) 1/2 of the street in front of the place where they are so building, unless another person is building on the opposite side of the street, in which case neither shall occupy more than 1/4 of the street; no person who is building shall continue such occupancy of any street after notice from any Independence Township official or police officer to discontinue same.
For violation of any provision of this chapter, the penalty, upon conviction, shall be a minimum fine of $100 and a maximum penalty of one or more of the following: a fine not exceeding $2,000, imprisonment not exceeding 90 days or a period of community service not exceeding 90 days. Except as otherwise provided, each and every day in which a violation of any provision of this chapter exists shall constitute a separate violation.
