This chapter is adopted pursuant to the authorization granted in N.J.S.A. 40:48-2.26 and 40:48-2.27 to regulate the height of all brush, hedges, and other plant life in close proximity to roadways, in order to protect the public health, safety, and welfare. See N.J.S.A. 40:48-1 and 40:48-2.
The terms listed in this section shall be defined in this chapter as follows:
BRUSH, HEDGES, AND/OR OTHER PLANT LIFE
All brush, hedges, and/or other similar plant life, and shall exclude trees.
ROADWAY
A. 
For paved or unpaved roads with curbs, the part of the right-of-way beginning at the edge of the curb nearest to the road; and
B. 
For paved or unpaved roads without curbs, the part of the right-of-way beginning at the edge of the pavement, gravel, or other road surface.
A. 
The owner or tenant of lands in the borough shall keep, or cause to be kept, all brush, hedges, and/or other plant life growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways, cut to a height of not more than 3 1/2 feet.
B. 
If any owner and/or tenant of lands in the borough shall fail to cut the brush, hedges, and/or other plant life in accordance with the provisions of § 173-3A, within 10 days after receipt of a written notice from the Borough requiring same, then the owner and/or tenant, upon a conviction, shall be liable for the penalties provided in this chapter.
A. 
If the owner and/or tenant of property fails to cut any brush, hedges and/or other plant life after receipt of the notice referred to in § 173-3B, and if in the opinion of the Construction Code Official it shall be necessary and expedient for the preservation of public safety that the borough cut the said brush, hedges, and/or other plant life in accordance with this chapter, then the Construction Code Official shall cause the brush, hedges, and/or other plant life to be cut in compliance with this chapter.
B. 
If the Construction Code Official causes any brush, hedges, and/or other plant life to be cut by the borough, then he or she shall certify the cost to the Mayor and Council. This cost, if approved by the Mayor and Council, shall be charged against the affected lands, shall become a lien upon such lands, and shall be added to and become and form a part of the taxes next to be assessed and levied upon the lands, and bear interest at the same rate as other taxes and shall be collected and enforced by the borough in the same manner as taxes.
Any person violating any of the provisions of this chapter shall, upon conviction, be punished by a fine not exceeding $1,000.
