As used in this chapter, the following terms shall have the meanings indicated:
RETAIL BUSINESS
All establishments open to the general public for the sale, rental, lease or distribution of any goods and/or services offered directly or indirectly for final consumption and not for further sale or processing, including but not limited to gasoline filling stations and/or automobile repair stations and restaurants.

A. 
It shall be unlawful for any person, firm or corporation to open any retail business to the public or in any way operate or conduct a retail business between the hours of 11:00 p.m. and 6:00 a.m.
B. 
The limitation of Subsection A applies to retail businesses in the A-1 and A-2 Residential Zones and also applies to all uses within the RC Zone, with the exception of government offices and facilities, restaurants, tavern/bar uses and banking uses limited to the operation of ATMs (automatic teller machines), as established in the Zoning Ordinance[1] and the Borough's Zoning Map.[2]

Any person, firm or corporation violating this chapter shall, upon a conviction, be punished by a fine of not less than $100 and not exceeding $1,000 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
