It shall be unlawful for any juvenile, as defined in §Â
102-5 below, to be present upon any public street, highway, road, right-of-way, alley, park, playground or other public place in the Township between the hours of 9:00 p.m. and 6:00 a.m. on nights before a school day or between the hours of 10:00 p.m. and 6:00 a.m. on other nights. On October 30 and 31 of each year, the restricted hours for juveniles shall be from 9:00 p.m. to 6:00 a.m., regardless of whether those dates are nights before a school day.
Every member of the Police Department, while on duty, is hereby authorized to detain any such minor violating the provisions of §Â
102-1 of this chapter until the parent or guardian of such child shall take him or her into custody. Such police officer shall immediately upon taking custody of such child contact the child's parent or guardian. In the event the police officer is unable to contact the child's parent or guardian, (s)he shall contact the New Jersey Division of Youth and Family Services and turn over custody of the child to the Division of Youth and Family Services.

As used in this chapter:
GUARDIAN
A person, other than a parent, to whom legal custody of the
minor has been given by court order or who is acting in place of the
parent or is responsible for the welfare of the minor.
PUBLIC PLACE
Any place to which the public has access, including but not
limited to a public street, road, thoroughfare, sidewalk, bridge,
alley, plaza, park, recreation or shopping area, public transportation
facility, vehicle used for public transportation, parking lot or any
public building or area.
