As used in this chapter, the following terms shall have the meanings indicated:
PERSONS, FIRMS, COMPANIES, ASSOCIATIONS and CORPORATIONS
Includes any person, firm, company, association or corporation which owns any machine as defined below and has control over such machine.
VENDING MACHINE
Any automatic machine used for the sale of milk, cream or other perishable food products and controlled and operated by the insertion of a coin or coins.
A. 
Any person, firm, corporation, company or association displaying for public patronage or keeping for operation any milk or cream vending machine shall be required to obtain an annual license for any said vending machine dispensing milk or cream, which license fee shall be $5 for each said machine operated within the Borough of Totowa.
B. 
Each license shall be for a specific location and shall expire on December 31 of the year for which it is issued.
C. 
There shall be issued no more than three licenses for the operation of such milk or cream vending machines within the Borough of Totowa during each calendar year, it being the intent herein to limit the number of milk or cream vending machines to three in number during each calendar year.
A. 
All milk or cream dispensed or sold in any such milk vending machine shall be from a source approved by the Board of Health of the Borough of Totowa and shall be changed and a fresh supply thereof placed in each machine daily.
B. 
The interior of such machine shall be so designed and constructed as to be readily cleaned and kept clean.
C. 
The refrigeration unit shall be of sufficient capacity to keep the entire contents of milk or cream at a temperature of 50° F. or below.
D. 
The vending machine shall be equipped with an automatic cutoff device that locks the machine when the temperature of the interior where milk or cream are stored goes above 50° F., and then returns patrons' coins. No milk then in the machine shall thereafter be sold from vending machines. Each machine shall contain a thermometer with the Fahrenheit scale thereon.
E. 
Vending machines shall be accurately labeled as to the product being dispensed therefrom.
Provision shall be made by the operator of the vending machine for inspection by the Board of Health at any time.
No license shall be issued unless the applicant shall first obtain from the Board of Health its written certification that the applicant has complied with all the rules and regulations established by the Board of Health with respect to the operation of such machine, and a written certification by the Construction Code Officer that the proposed location of such machine is in compliance with the Zoning Ordinance of the Borough of Totowa.[1]
