GENERAL REFERENCES

Solid waste — See Ch. 341.
No garbage or refuse shall be dumped in the Borough of Totowa without a permit having first been granted by the Board of Health.
As used in this chapter, the following terms shall have the meanings indicated:
GARBAGE and REFUSE
Includes the following forms of discarded material in solid or semisolid form:
A. 
Household waste, garbage, swill, slops, sweepings, bones or grease.
B. 
Offal or manure.
C. 
Rubbish, trash, rags, furniture, bedding, rubber, fabrics or excelsior.
D. 
Ashes, cinders or soot.
E. 
Barrels, boxes or crates.
F. 
Debris, rubble or glass.
G. 
Dead animals.
H. 
Vegetation, grass, leaves, branches, brush, weeds, clippings, cuttings, stumps or tree trunks.
I. 
Paper, cartons or bags.
J. 
Unclean or contaminated soil or earth.
K. 
Junk, scrap metal, cans, plumbing fixtures or machinery parts.
L. 
Scrap building material, rocks, concrete, plaster, asbestos, brick, lumber, sand, gravel, tiling or shingles.
M. 
Shop, store, office, factory or industrial waste of all kinds.
Application for a permit to dump garbage or refuse shall be made in writing to the Secretary of the Board of Health; said application shall set forth the name and address of the applicant and the location of the property for which the permit is sought. If the applicant is a person other than the owner of the property for which the permit is sought, the consent of the property owner to the granting of the requested permit shall be endorsed upon the application.
A permit shall be required under the provisions of this chapter even if the percentage of garbage or refuse, as above defined, in materials to be dumped shall be only a small percentage of the total volume of such materials, and any materials that in the opinion of the Board of Health might be vermin-attracting, insect-breeding or a fire hazard will be considered to be included in the meaning of the words "garbage" and "refuse."

A. 
A fee of $25 shall accompany every application for a permit to collect garbage and refuse in the Borough of Totowa under a private contract with an individual, firm or corporation.

B. 
The permit, when granted, shall expire on December 31 each year and shall not be transferable.
No site of a dumping ground shall be so situated as to create a nuisance. Garbage or refuse when dumped shall be covered with earth fill, to the extent of at least six inches, once each week. If the Health Officer of the Borough of Totowa determines that, at any time in any given case, a greater covering of fill is necessary or a more frequent covering with earth fill is necessary to preserve the public health or to eliminate or prevent the existence of a nuisance, the Board of Health may order the person given a permit to dump to abide by the decisions of the Health Officer to the foregoing effect.
Any person, firm or corporation holding a contract to collect garbage and refuse in the Borough of Totowa shall immediately, upon the completion of loading of any truck or vehicle used for such collection, securely cover said truck or vehicle with canvas or in some similar manner so that none of the contents of the truck or vehicle can spill out on the roads of the Borough. In the event of the violation of this section, any such person, firm or corporation shall be held liable as well as the driver or operator of any such truck or vehicle.
Any person, firm or corporation transporting garbage and refuse through the Borough of Totowa shall have all trucks or vehicles used for such transportation securely covered with canvas or in some similar manner so that none of the contents of the trucks or vehicles can spill out on the roads of the Borough. All such trucks or vehicles so used shall traverse the main thoroughfares of the Borough, using the most direct routes possible to arrive at their destination, and shall not traverse any other streets except in the case of emergency or by special permission of the Board of Health. In the event of the violation of this section, the owner or owners of the trucks or vehicles shall be held liable as well as the drivers or operators of any such trucks or vehicles.
