GENERAL REFERENCES

No person, firm or corporation shall operate or cause to be operated any taxicab in the Village of New Haven without having first obtained a license to operate such taxicab.
No person shall be granted a license unless he is at the time of making application a resident of the Village and has been such resident of the Village for six months preceding his application. Removal from the Village shall automatically render the license void.
Any person desiring a license to operate a taxicab in the Village of New Haven shall file a written application stating:
A. 
His name, age, residence and occupation and, if the applicant is a partnership, the name, addresses and occupations of the partners and, if the applicant is a corporation, the names, addresses and occupations of the officers and directors of said corporation.
B. 
A complete description of the vehicle intended to be used as a taxicab.
C. 
Whether there are any unpaid or unbonded judgments against the applicant, and if so, details as to court, amount of judgments, etc.
D. 
The experience of the applicant as a motor vehicle operator.
E. 
Whether or not the applicant has pleaded guilty or been convicted of any crime, and if so, the details of same, including the court where conviction was obtained or a plea of guilty was entered.
F. 
The place within the Village of New Haven where applicant will have his office and from which he proposes to operate such taxicab.
G. 
Whether the applicant is the owner of the taxicab, and if not, details as to the ownership of same.
H. 
Such other information as the Village Council may require.
The Chief of Police shall cause an investigation to be made of the character, fitness and qualification of the person applying for such license and the fitness of the proposed taxicab for use as such. The application, together with the report of the Chief of Police, shall be filed with the Village Council, which may grant or refuse to grant said license in its sole discretion.
Licenses granted by the Village Council shall be issued by the Village Clerk upon the payment of the fee hereinafter required and the deposit with the Clerk of adequate policies of liability insurance.
All licenses issued hereunder shall expire on May 1 following the issuance thereof.
A fee of $10 for each taxicab license shall be paid to the Village Clerk before the issuance of such license. Such licenses shall be nontransferable to other persons but a license may be transferred to other vehicles, subject to the approval of the Village Council, upon favorable report of the Chief of Police and the payment of a transfer fee of $2.
Licenses may be suspended or revoked by the Village Council at any time in case where:
A. 
False or misleading information was given in the application.
B. 
The Council finds that the owner or any driver in his employ has failed to comply with and observe the ordinances of the Village of New Haven and the statutes of the State of Michigan with reference to the operation of motor vehicles.
C. 
Fares are charged in excess of those authorized by the Village Council.
The licensee shall file a copy of his insurance policy with the Village Clerk and said insurance policy, among other things, shall provide for public liability in the minimum amount of $10,000 for one person and $20,000 for more than one person and a minimum of $1,000 for damage to property. Such policy shall further provide that same shall not be cancelled, surrendered or revoked until after 10 days' written notice is furnished by the insurance company to the Clerk of the Village of New Haven. Cancellation, surrender or revocation of such insurance shall automatically terminate the license for the taxicab covered by such insurance.
A. 
No person shall drive a taxicab on the streets of the Village of New Haven without first having obtained a driver's permit from the Village Clerk. Application for such permit shall be made to the Village Clerk and shall set forth the applicant's name, age, residence, occupation and the fingerprints of such applicant; also, the experience of the applicant in the operation of a motor vehicle and whether or not the applicant has over been convicted of or pleaded guilty to any felony, crime or misdemeanor, and if so, the details of such. No driver's permit shall be issued to any person unless he shall hold a chauffeur's license authorized by the Secretary of State, and in the event such chauffeur's license is revoked, suspended or is not renewed, such driver's permit to operate a taxicab in the Village of New Haven shall be revoked.
B. 
Before a driver's permit is issued, an investigation shall be made by the Chief of Police and his report shall be filed with the Village Council. If the Village Council shall grant the permit, same shall be issued by the Village Clerk upon payment of a fee of $2. Driver's permits shall expire on May 1 following issuance thereof and, subject to the approval of the Village Council, may be renewed upon application and payment of the permit fee. Driver's permits shall be nontransferable and it shall be unlawful for any taxicab owner to allow any person not holding a driver's permit to operate such taxicab.
The rates of fare to be charged for taxicab service in the Village of New Haven shall not exceed the rates approved from time to time by the Village Council, and the owner of a taxicab shall submit proposed rates to the Village Council and obtain approval thereof before commencing the taxicab business. The rates of fare approved by the Village Council shall be plainly displayed on a card within the taxicab licensed.
A. 
The owner of each taxicab licensed hereunder shall maintain said taxicab in good mechanical condition and, at least every three months, submit said taxicab to an examination and or test by the Chief of Police as to the condition of its brakes, power, lights and tires, and the Chief of Police shall file a report of such inspection and examination with the Village Council.
B. 
The owner or driver of such taxicab shall within 24 hours report all accidents arising out of the operation of said taxicab and all lost articles found in said taxicab to the Chief of Police.
C. 
No taxicab driver shall drink beer, wine, spirits, alcoholic beverages or liquors while on duty.
D. 
No driver or owner of a taxicab shall refuse or neglect to convey any orderly person or persons on request by signal or telephone call, unless, the taxicab is previously engaged. When a taxicab has been engaged by a passenger, no additional passengers shall be received therein except by the express consent of the first passenger.
E. 
Subject to the approval of the Village Council, the Chief of Police shall have power to establish such taxicab stands as in his discretion are necessary for the proper service of the public.
A. 
Violations. Any person, firm, corporation, owner or driver who shall violate any provision of this chapter shall be subject to the penalties hereinafter provided.
B. 
Penalties. Any person, firm, corporation, owner or driver who or which violates or fails to comply with any provision of this chapter shall be subject to the penalties set forth in Chapter 59, Municipal Civil Infractions, of the Code of the Village of New Haven.
