Under authority of Titles III, VI and VII of the City Charter of the City of Watertown, the following rules and regulations are hereby promulgated by the City of Watertown pertaining to the discharge of stormwater, well water, groundwater, cooling water, unpolluted water, industrial wastewater, sewage or other wastewater in the City sewer system.
These rules and regulations set uniform requirements enabling the discharges into the wastewater collection and/or treatment system of the City of Watertown by users whose discharges do not originate within the corporate limits of the City. Additionally, these rules and regulations provide the means for the establishment of an outside user fee and collection system fee.
It is intended that all requirements contained within adopted municipal codes, local laws and ordinances, as currently amended, as well as future amendments to the same, governing the definition of terms, uses, prohibited uses and discharge limitations to the City of Watertown's wastewater collection and/or treatment system shall remain in effect and apply here. Specific reference is made to Parts 1, 2 and 3 of this chapter.
As used in this Part 4, the following terms shall have the meanings indicated:
AUTHORITY
The Development Authority of the North Country.
INCH DIAMETER-MILE (IDM)
The product of a sewer's diameter (in inches) times its length (in miles).
OUTSIDE USER
Any person, group of persons, corporations, governmental bodies, etc., who contract with the City as a unit and contribute, cause or permit the contribution of wastewater into the City of Watertown's collection and/or treatment system where the origin of the wastewater is outside the corporation boundaries of the City.
SIGNIFICANT INDUSTRIAL USER
All users (not limited to solely industrial facilities), but excluding the Authority, meeting one or more of the criteria specified by definition contained in Part 3 of this chapter.
A. 
All costs incurred by the City at its pollution control plant as a result of accepting wastewater from outside users shall be recovered via an outside user fee.
B. 
The total cost to be recovered by the outside user fee shall be comprised of the following elements:
(1) 
All costs, including but not limited to administration, legal, interest on temporary financing, construction, engineering and inspection, related to the expansion of the pollution control plant from an eight-million-gallon average daily flow to a thirteen-and-four-tenths-million gallon average daily flow facility.
(2) 
A share of the debt service on those pollution control plant process equipment and facilities existing prior to the expansion of the plant from an eight-million-gallon average daily flow to a thirteen-and-four-tenths-million-gallon average daily flow facility and which will be used for the treatment of sewage originating from both out side users as well as users inside the corporation boundaries of the City of Watertown. The share shall be equal to the ratio of the average daily flow of all outside users divided by the average daily flow of all users.
(3) 
A share of the total pollution control plant operation and maintenance costs as defined by the G8130 account of the City's Sewer Fund. The share shall be equal to the ratio of the average daily flow of all outside users divided by the average daily flow of all users.
C. 
An individual outside user fee shall be the individual outside user's share of the total cost to be recovered by the outside user fees. The individual outside user's fee shall be computed in accordance with the formula which follows:

A. 
All costs incurred by the City for its wastewater collection system as a result of accepting wastewater from outside users shall be recovered via a collection system fee.
B. 
The total cost to be recovered by the collection system fee shall be comprised of the following elements:
(1) 
A share of the debt service on all components of the wastewater collection system. The share shall be computed in accordance with the formula which follows.
(2) 
A share of the operation and maintenance cost of the wastewater collection system as defined by the G8120 account of the City's Sewer Fund. The share shall be computed in accordance with the formula which follows.

C. 
Those users discharging directly to the City's wastewater treatment facilities and, thereby, not utilizing any portion of the City's wastewater collection system shall be exempt from the collection system fee.
Under no circumstances shall the total fee (outside user fee plus the collection system fee) assessed an outside user be permitted to be less than 120% of the total sewer service charge assessed a user within the corporation boundary of the City of Watertown for an equal volume of wastewater collected and treated.
The City Manager of the City of Watertown is authorized to enter the City into contractual agreements with designated outside users, subject to City Council approval.
Outside users shall be required to install a monitoring facility at the point their discharge first enters the City's wastewater collection or treatment system. Monitoring facilities shall be constructed, operated and maintained at the user's expense. The purpose of the facility is to enable inspection, sampling and flow measurement of wastewaters produced by the user. Continuous flow monitoring and recording is required and shall be installed, operated and maintained at the user's expense. There shall be accommodations to allow safe and immediate access for authorized City personnel. There shall be ample room in or near such facility to allow accurate sampling and compositing of samples for analysis.
Designation of an outside user and significant industrial user shall require that individual outside users comply with the City's rules and regulations relating to the industrial use of the public sewer system (Part 3 of this chapter).
The specific mechanism by which the City shall enter into an agreement with an outside user shall be by contract of specified duration. All requirements of existing codes, laws and ordinances, as currently amended, shall be secured via this contract.

A. 
It is intended that the limitations expressed by § 253-68 above shall also apply to sewage, septage and slurries delivered to the City's wastewater treatment plant via any and all tankers permitted to convey such material by the New York State Department of Environmental Conservation. The outside user fee and collection system fee, however, does not apply to tanker-hauled sewage, septage and slurries. Fees required to enable the acceptance and treatment of tanker-hauled sewage, septage and slurries shall be as follows:

(1) 
Five and one-half cents ($0.055) per gallon for all sewage, septage and slurries less than or equal to 5.6% solids by weight.
(2) 
For all leachate: five and one-half cents ($0.055) per gallon.
(3) 
Twelve cents ($0.12) per pound (dry weight) for all deliveries over 5.6% solids by weight.
(4) 
Minimum charge of $39.29 per delivery.
B. 
The above fees are subject to adjustment by resolution of the City Council of the City of Watertown should the cost of treatment and disposal, in the opinion of the City Council, warrant such an adjustment.
C. 
All outside user sources and haulers will be required to have a permit prior to acceptance of waste.

Composite sampling and analysis by the City during a particular month revealed the following data on liquid wastes from User A, whose sewer service charge for that month is $1,000.
