A.
For all excavation, construction, destruction, or
repair on or of any public street, highway, road, or sidewalk, or
upon land adjacent to any public street, highway, road or sidewalk
which causes or may cause a hazard to vehicular traffic, pedestrian
traffic, or to public safety, advanced written notice shall be given,
on forms provided, to the Chief of Police or his/her agent, a minimum
of 24 hours prior to work being commenced, except in the case of an
emergency. In the case of an emergency, the Chief of Police or his/her
agent shall be notified by telephone of the location and extent of
the emergency, prior to work being commenced.
B.
For all utility work pertaining to the installation,
removal or updating of any utility, including, but not limited to,
electric, telephone, cable, or fiber optic lines and structural supports
thereof, which causes or may cause a hazard to vehicular traffic,
pedestrian traffic, or to public safety, advanced written notice shall
be given on forms provided, to the Chief of Police or his/her agent,
a minimum of 24 hours prior to work being commenced, except in the
case of an emergency. In the case of an emergency, the Chief of Police
or his/her agent shall be notified by phone of the location and extent
of the emergency, prior to work being commenced.
The organization or person performing the work
(hereinafter the "applicant") shall safeguard the security of the
general public, protect the public from injury or harm, and ensure
that public rights are not unreasonably curtailed under this section.
The hazard of the work or potential thereof
shall be determined by the Chief of Police or his/her agent. Such
circumstances shall include, but not be limited to, the effect on
traffic patterns and flow of traffic at time and place the work is
to be performed as well as the general interest in traffic control
and public safety.
A.
If the location and extent of work is such that the
Chief of Police or his/her agent believes that a uniformed police
officer(s) is required, such uniformed police officer(s) shall be
provided at the expense of the applicant. Where such uniformed police
officer(s) provides services to more than one applicant, each applicant
shall be responsible proportionately for such expense. If such conditions
exist at the close of the working day, a watchman and a sufficient
number of traffic control persons shall be employed and assigned by
the applicant to direct traffic at night. The work shall be planned
to avoid such conditions whenever possible.
B.
If no regular member of the Woodbridge Police Department
is available, the applicant shall provide a trained flagger, equipped
with a reflective vest. The trained flagger's sole responsibility
shall be to control vehicular and pedestrian traffic at all times
that such work causes or may cause a hazard to vehicular or pedestrian
traffic. When such a trained flagger is not provided to the work site
and when a hazard or potential hazard exists to vehicular or pedestrian
traffic, any regular member of the Woodbridge Police Department is
authorized to suspend further activities at such site until such site
can be made safe by adequate police protection or utilization of a
trained flagger.
Any applicant making any opening or excavation
in a right-of-way shall establish and maintain protective safety measures
at any such opening or excavation. The applicant shall be responsible
for the costs of the protective safety measures.
The applicant shall take appropriate measures
to assure that during the performance of the work traffic and pedestrian
conditions can be maintained as near to normal as possible at all
times, so as to minimize inconvenience to the occupants of adjoining
property and to the general public.
Public utility companies or any other entity
responding to an emergency situation that poses an imminent threat
to public safety may utilize a traffic control person until a police
officer arrives at the location to take over traffic control duties.
The applicant may also request a marked patrol
vehicle to provide for increased awareness to vehicular and pedestrian
traffic. The cost of such marked patrol vehicle shall be determined
by the Town of Woodbridge. The ability to provide such a marked patrol
vehicle will be based on the discretion of the Chief of Police or
his/her agent.
Every person, firm, or corporation who shall
violate any of the provisions of this article shall be guilty of a
violation and, upon conviction, shall be punished by a fine of not
more than $100 for each violation, and each day of the continuance
of said violation shall constitute a separate and distinct offense.
In the event of any questions as to the interpretation
of any part of this article, the decision of the Chief of Police or
his designee shall be final.
