Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
Whenever certain hours are named in this Chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the Borough.
The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

A. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY-NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY-NO PARKING signs when weather conditions, accidents, fires, or public celebration, dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification of the EMERGENCY-NO PARKING signs are being or will be posted and shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
C. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I attached to and made a part of this chapter.[1]

No person shall stop or stand a vehicle between the hours specified in Schedule III of any day (except Saturdays, Sundays and public holidays) upon any of the streets or parts of streets described in Schedule III attached to and made a part of this chapter.[1]

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV of any day (except Saturdays, Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV attached to and made a part of this chapter.[1]

In order to facilitate snow or leaf removal and the adequate cleaning of streets, no vehicle shall be parked upon the side of any street described in Schedule V attached to and made a part of this chapter.[1] For these purposes, the Borough is divided into areas designated as shown on the map of the Borough of Highland Park attached hereto and made a part of this chapter.
A. 
Area A. Begins at Raritan Avenue at the bank of the Raritan River, running easterly along the center line of Raritan Avenue to the center line of Fourth Avenue; thence southerly along the center line of Fourth Avenue to a point on the bank of the Raritan River; thence in a general westerly and northerly direction along the course of the Raritan River to the point of beginning.
B. 
Area B. Begins at Raritan Avenue on the Bank of the Raritan River, running easterly along the center line of Raritan Avenue to the center line of Fourth Avenue; thence northerly along the center line of Fourth Avenue to the center line of Lincoln Avenue; thence easterly along the center line of Lincoln Avenue to North Fifth Avenue and the boundary line with Edison Township; thence northwesterly along the boundary line of Edison Township to the boundary line of Piscataway Township; thence southwesterly along the boundary line of Piscataway Township to the bank of the Raritan River; thence in a general southeasterly direction along the course of the Raritan River to the point of beginning.
C. 
Area C. Begins at the center line of the intersection of Raritan Avenue and Fourth Avenue; thence easterly along the center line of Raritan Avenue to the center line of Woodbridge Avenue; thence easterly along the center line of Woodbridge Avenue to the Edison Township boundary line; thence southerly along the Edison Township boundary line to a point on the bank of the Raritan River; thence in a general westerly direction along the course of the Raritan River to a point marking the extension of the center line of South Fourth Avenue; thence northerly along the center line of South Fourth Avenue to the point of beginning.
D. 
Area D. Begins at the center line of the intersection of Raritan Avenue and Fourth Avenue; thence easterly along the center line of Raritan Avenue to the boundary line of Edison Township; thence westerly along the boundary line of Edison Township to the center line of Lincoln Avenue; thence along the center line of Lincoln Avenue to the center line of North Fourth Avenue; thence southerly along the center line of North Fourth Avenue to the point of beginning.
E. 
Area E. Begins at a point in the center line of the intersection of Raritan Avenue and Woodbridge Avenue; thence easterly along the center line of Woodbridge Avenue to the boundary line of Edison Township; thence easterly, northerly and westerly along the boundary line of Edison Township to the center line of Raritan Avenue; thence westerly along the center line of Raritan Avenue to the point of beginning.

A. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on roadways or portions wherein signs are erected prohibiting parking as described in Schedule VI attached to and made a part of this chapter.[1]

B. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
C. 
Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where temporary "EMERGENCY-NO PARKING" signs are displayed. The Chief of Police, or in his absence the ranking police officer, is authorized to declare an emergency and to direct the posting of the "EMERGENCY-NO PARKING" signs when weather conditions, accidents, fires, or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
D. 
Notification that the "EMERGENCY-NO PARKING" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
E. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed to be a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

In order to facilitate the adequate sweeping of streets, no vehicle shall be parked between the hours specified on the side of any street described in Schedule XIX, Parking Prohibited During Street Sweeping, attached to and made a part of this chapter.[1]

Except when necessary to avoid conflict with other traffic or in compliance with the directions of a traffic or police officer or traffic sign or signal, no operator of a vehicle shall park, stop or stand the vehicle in any of the following places:
A. 
Within 10 feet of a fire hydrant;
B. 
On a crosswalk;
C. 
Within 25 feet of the nearest crosswalk or sideline of a street;
D. 
Within 50 feet of a stop sign as established by § 7-6 of this chapter;
E. 
Within an intersection;
F. 
Within a bus stop as established by § 7-9 of this chapter;
G. 
Outside the lines or markings of a designated parking space, or in such a manner as to be "double parked";
H. 
Within a private driveway and/or parking lot without the consent of the owner;
I. 
Within a designated loading zone as established by § 7-7 of this chapter;
J. 
Within a designated taxi stand as established by § 7-8 of this chapter;
K. 
On the roadway side of any vehicle stopped or parked at the edge or curb of a street.

Pursuant to the authority granted to this municipality by N.J.S.A. 39:4-197, the following locations are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the New Jersey Motor Vehicle Commission. No other person shall be permitted to park in these spaces.

Vehicles over four tons are hereby prohibited from parking, stopping or standing on any street within the Borough of Highland Park except on those streets designated by ordinance as truck routes.
Notwithstanding the provisions of § 7-4.1, and pursuant to the provisions of N.J.S.A. 40:67-16.1, the streets or parts of streets as described in Schedule VII attached to and made a part of this chapter are hereby designated as routes for trucks over four tons.[1]

Unattached boat trailers, cargo trailers, construction trailers, and recreational trailers are prohibited from parking, stopping or standing on any street within the Borough of Highland Park except as specifically permitted by the Borough ordinance.
The following vehicles are exempt from complying with this section:
A. 
Borough sanitation vehicles.
B. 
Borough recycling vehicles.
C. 
Borough Fire Department and Rescue Squad vehicles.
D. 
Public utility vehicles.
E. 
Construction vehicles on job sites where authorized or sanctioned by the Borough of Highland Park.

The streets or parts of streets described in Schedule VIII attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.[1]

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule IX attached to and made a part of this chapter are hereby designated as through streets.[1] Stop signs shall be installed on the near right side of each street intersecting the through street except where yield signs having sides 36 inches in length are provided for in the designations.

A. 
The streets or parts of streets described in Schedule XVIII attached to and made a part of this chapter shall have the speed limits designated in such schedule.[1]

B. 
Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.

No vehicle shall be parked upon any public street displaying such vehicle for sale.

No vehicle shall be greased or repaired upon any public street or Borough owned parking lot or property, except for emergency repairs.
No vehicle shall be operated or parked upon any public street with display or sound advertising.

The purpose of this section is to regulate electric scooters. This section shall apply to electric scooter operations and the placement upon any street or upon any public right-of-way within the Borough.
A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
ELECTRIC SCOOTER
A scooter with a floorboard that can be stood upon by the operator, with handlebars, and an electric motor that is capable of propelling the device with or without human propulsion at a maximum speed of 19 miles per hour.
OWNER
Any company, entity or individual that has ownership of an electric scooter.
PRIVATE ELECTRIC SCOOTER
Any electric scooter owned and operated by a private individual.
SHARED ELECTRIC SCOOTER
Any electric scooter owned by a company authorized and permitted by the Borough of Highland Park to offer publicly electric scooters through a pay-per-ride or subscription program.
USER
Any person who is operating an electric scooter.
B. 
Application of motor vehicle laws to electric scooters. Every person riding an electric scooter within the Borough of Highland Park shall be granted all the rights and shall be subject to all the duties applicable to the driver of a vehicle by the laws of this state, including the provisions of Chapter 4 of Title 39 of the New Jersey Revised Statues applicable to bicycles as defined in N.J.S.A. 39:4-10 and the traffic provisions of this Code applicable to the driver of a vehicle, except as to special regulations in this section and except as to those provisions of laws and ordinances which by their nature are inapplicable to such persons.
C. 
Electric scooter rules and regulations. Rules and regulations shall pertain to electric scooters and their operation within the Borough:
(1) 
Obedience to traffic control devices. Any person operating an electric scooter shall comply with New Jersey Statutes, including Chapter 4 of Title 39 of the Revised Statutes, Rules and Regulations applicable to bicycles as defined in N.J.S.A. 39:4-10.

(3) 
User age restrictions. Electric scooter operators should follow the manufacturer's recommendation regarding age of rider.
(4) 
Helmet requirements. Electric scooter operators under the age of 17 must wear a helmet per N.J.S.A. 39:40-10.1.
(5) 
Manner of riding. No electric scooter shall be used to carry more persons at one time than the number for which it is designed and equipped.
(6) 
Speed restrictions. No person shall operate an electric scooter at a speed greater than is reasonable and prudent under the condition then and there existing, provided it does not exceed 19 miles per hour.

(8) 
Riding on sidewalks.
(a) 
No person shall ride an electric scooter upon a sidewalk.
(b) 
Any person traveling on the sidewalk with an electric scooter shall dismount before entering the sidewalk throughway and walk the electric scooter along the sidewalk.
(c) 
No person shall start or stop an electric scooter trip on the sidewalk.
(9) 
Carrying articles. No person operating an electric scooter shall carry any package, bundle, or article which prevents the user from keeping both hands upon the handlebars.

(11) 
Lamps and equipment on electric scooters.
(a) 
Electric scooters in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front with a lamp emitting a red light visible from a distance of 500 feet to the rear.
(b) 
Electric scooters shall be equipped with a kickstand to prevent them from toppling over when parked.
(12) 
Electric scooter parking/placement.
(a) 
Private electric scooters are permitted to be secured at municipal bicycle racks for up to four consecutive days without being utilized.
(b) 
Private electric scooters may be attached or secured to the bicycle rack. No person shall attach or secure an electric scooter to any fixed object not suited for electric scooter parking or typically used for bicycle parking.
(c) 
Electric scooters shall be parked in designated electric scooter parking areas if they are available and advertised as such by either signage, pavement markings or racks.
(d) 
No person or owner shall leave an electric scooter lying on or standing upon the sidewalk or any portion of the Borough's right-of-way so as to hinder or impede pedestrian access.
(13) 
Abandonment of electric scooters.
(a) 
An electric scooter may be deemed abandoned by the Borough if:
[1] 
It has been parked for a period of 48 or more consecutive hours, except in designated bicycle racks and approved marked areas;
[2] 
It appears visually to be in a state of prolonged disuse such that it has deflated tires, damaged or missing equipment making it inoperable, accumulated debris associated with it; or
[3] 
It is parked, placed or left on a roadway or in any public right-of-way in violation of this chapter.
(b) 
It shall be unlawful for any person, user or owner to abandon any electric scooter within the Borough.
(c) 
In the event that an electric scooter is deemed to be abandoned as defined herein, the Borough's Department of Public Works, the Police Department or the Department of Code Enforcement shall have the authority to seize and impound same pursuant to this section and that it will be removed.
(14) 
Shared electric scooter rental restriction. The shared electric scooter user shall be the same person who made the rental reservation. No person shall rent a shared electric scooter for another user.
(15) 
Electric scooter charging. No electric scooter battery shall be recharged in the public right-of-way without prior written authorization from the Borough.
(16) 
Electric scooter disposal. All electric scooters shall be disposed of in a manner in accordance with state and federal regulations as they relate to hazardous materials disposal.
(17) 
All operators of electric scooters shall certify once (at the time of sign-up for an electric scooter program prior to riding) that they have read the state law (N.J.S.A. 39:1-1 et seq.) and the herein ordinance governing electric scooter use.
(18) 
Electric scooters shall only be operated on bicycle paths and roadways in public parks.
D. 
Violations and penalties.
(1) 
Except as detailed below, in the event that any user or owner violates the terms of this section, the violator shall be subject to a fine in the Municipal Court of the Borough of Highland Park in an amount of $100 for a nonmoving violation. No court appearance shall be required for this violation.
(2) 
If the offense involves a moving violation under N.J.S.A. Title 39, then the violation shall be subject to appropriate Title 39 penalties as determined by the Municipal Court Magistrate.
E. 
Voluntary personal scooter registration. Any resident of the Borough that desires to voluntarily register their privately owned personal electric scooter may do so with the Highland Park Police Department.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both, providing that the penalty for overtime parking shall not be less than $20.

All former traffic ordinances of the Borough of Highland Park covered in this Traffic Chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Chapter.
