There is hereby created within the Borough a Department of Code Enforcement which shall serve to protect the health, safety and welfare and enhance the quality of life for the Borough residents through the proper and efficient enforcement of the regulations and codes described herein.
The Department of Code Enforcement shall consist of the following divisions: Construction, Housing, Fire Prevention, Health, Vital Statistics, Property Maintenance, Planning and Zoning.
The Department of Code Enforcement enforces the New Jersey State Uniform Construction Code, New Jersey State Uniform Fire Code, New Jersey State Hotels and Multiple Dwelling Regulations, International Property Maintenance Code and the Municipal Land Use Law as more fully described in the sections herein.
A. 
The Department of Code Enforcement shall be under the control and supervision of a Director of Code Enforcement to be appointed by resolution of the Borough Council at such salary as shall be fixed by ordinance or resolution by the Borough Council.
B. 
The Department of Code Enforcement shall consist of but not be limited to the following: Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official and Fire Subcode Official, and such other subcode officials for each additional subcode as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code, Fire Official, Zoning Official, Registrar of Vital Statistics, inspectors and additional personnel as deemed necessary by recommendation of the Borough Administrator.
C. 
Appointment, term of office and removal.
(1) 
Inspectors and additional personnel, as deemed necessary by the Borough Administrator, shall be appointed by the Borough Council as required by law. Inspectors and additional personnel of the department shall be subject to removal by the Borough Administrator for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
(2) 
The Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official and Fire Subcode Official shall serve for a term of four years. The Fire Official shall serve for a term of four years. Any vacancy in the Fire Official's position shall be filled for the unexpired term.
