[HISTORY: Adopted by the Mayor and Council
of the Borough of Essex Fells 3-15-2005 by Ord. No. 2005-785 (Ch. 9.16 of the

The purpose of this chapter is to establish
an approved map as an official finding and record of Borough properties
used for school purposes, of the property within 1,000 feet of such
school property and of public buildings and the property within 500
feet thereof in order to serve as evidence in or to otherwise assist
in prosecutions for driving while intoxicated pursuant to N.J.S.A.
39:4-50 and for certain controlled dangerous substance offenses pursuant
to N.J.S.A. 2C:35-1 et seq.
Pursuant to N.J.S.A. 2C:35-7, N.J.S.A. 2C:35-7.1
and N.J.S.A. 39:4-50, the Borough of Essex Fells governing body does
approve and adopt the map entitled "Drug Free Zone Map," prepared
by Charles P. Stewart of GC Stewart Associates, Inc., dated March
31, 2004, as the official finding and record of the property used
for school purposes which is owned by or leased to any elementary
or secondary school or school board and property within 1,000 feet
of such school property and the property comprising public parks and
public buildings as defined in N.J.S.A. 2C:35-7.1 and property within
500 feet thereof. From time to time the Borough governing body may,
by ordinance, approve and adopt revisions to such map.
The original map or revisions to such map, or
a true copy thereof, shall be filed and maintained within the office
of the Borough Clerk.
