Any person convicted of a traffic infraction
for a violation of any provision of this chapter which is not a violation
of any provision of the Vehicle and Traffic Law of the State of New
York, nor a violation of the Transportation Law of the State of New
York, nor a violation of the Tax Laws of the State of New York, nor
a violation of the Code of Federal Regulations shall, for a first
conviction thereof, be punished by a fine of not more than $200 or
by imprisonment for not more than 15 days, or by both such fine and
imprisonment; for a second such conviction within 18 months thereafter,
such person shall be punished by a fine of not more than $300 or by
imprisonment for not more than 45 days, or by both such fine and imprisonment;
upon a third or subsequent conviction, such person shall be punished
by a fine of not more than $400 or by imprisonment for not more than
90 days, or by both such fine and imprisonment.
A.
The following parking fines shall be provided:

For a violation of parking within 15 feet of any fire hydrant: $110.

For a violation of double parking: $50.

For a violation of blocking a driveway: $50.

For a violation of stopping, standing or parking where a prohibition
against such has been posted: $50.

For a violation of parking within an area designated as a bus

For a violation of interfering with snow removal/street-cleaning
operations: $100.

For a violation relating to abandoned vehicles: $200.
(16)
For a violation of stopping, standing or parking in an alley
and/or allowing less than 15 feet for the free flow of traffic: $50.

(17)
For a violation of parking or standing in an area designated
for handicapped access only: $100.
(18)
For parking in an area designated for police cars or City-owned
vehicles: $100.
(19)
For a violation of the section relating to parking or standing
in the Watervliet Plaza: $50.
(21)
For a violation of parking in a designated:fire lane: $50.
(22)
For a violation relating to stopping, standing or parking vehicles
in alleys: $50.

B.
The following moving violation fines shall be provided:
(1)
Minimum of $50 for a violation of a designated stop
sign.
(2)
Minimum of $50 for a violation of a designated one-way
street.
(3)
Minimum of $50 for a violation of a designated traffic
control signal.
(4)
Minimum of $50 for a violation of a prohibited turn.
(5)
Minimum of $50 for a violation of a mandated turn.
(6)
Minimum of $50 for a violation of a designated yield
intersection.
(7)
A minimum fine of $100 and a maximum fine not to exceed
$250 or 10 days' imprisonment for a violation of trucks exceeding
gross weights as established.
C.
When tickets issued by the City Police Department
have not been paid within 30 days of issuance, the amount of the fine
indicated on the face of the ticket will be doubled.
A.
It is required that all vehicles operated within the
City of Watervliet be in good and safe operating condition.
(1)
Each shall be operated only while:
(a)
Having a valid New York State certificate of
inspection, or the equivalent thereof, for any vehicle registered
outside the State of New York, affixed on the vehicle in the proper
location.
(b)
In full compliance with Article 9 of the Vehicle
and Traffic Law of the State of New York, as amended, which Article
is fully incorporated herein by reference.
(c)
In full compliance with Article 10 of the Vehicle
and Traffic Law of the State of New York, as amended, which Article
is fully incorporated herein by reference.
(d)
In full compliance with Article 2 of the Transportation
Law of the State of New York, as amended, which Article is fully incorporated
herein by reference.
(e)
In full compliance with Article 6 of the Transportation
Law of the State of New York, as amended, which Article is fully incorporated
herein by reference.
(f)
In full compliance with Article 21 of the Tax
Law of the State of New York, as amended, which Article is fully incorporated
herein by reference.
(g)
In full compliance with Article 49 of the Code
of Federal Regulations, as amended, which Article is fully incorporated
herein by reference.
(2)
No vehicle may operate within the City of Watervliet
if that vehicle has been determined to be in an unsafe condition by
a certified New York inspector or by a person certified by the State
of New York to conduct such inspections.
(3)
No vehicle may operate within the City of Watervliet
if it has been determined that the vehicle should be put out of service
by a New York State Department of Transportation inspector.
B.
It shall be presumed that a violation of this section
found through an inspection of a vehicle requested by an officer of
the Police Department of the City of Watervliet and inspected in the
presence of an officer thereof, after the vehicle was involved in
an accident, was a violation at the time of the accident. Any such
inspection shall take place only after at least two days' notice is
given to the owner of the vehicle, and the owner and/or person or
persons he shall designate shall have the right to attend the inspection.
