It shall be unlawful for the owner, custodian or keeper of any dog to allow such dog to run at large at any time, either upon any of the roads, streets, alleys or public grounds in the Township of East Caln or upon the property of anyone other than the owner, custodian or keeper of such dog.
The words "run at large" or "running at large" shall mean any dog when it is off the property of its owner, custodian or keeper and not under restraint or control of a competent person.
The owner of owners of every dog within the Township of East Caln shall at all times keep such dog either:
A. 
Confined within an enclosure from which it cannot escape.
B. 
Firmly secured by means of a collar and chain.
C. 
Under the immediate control of the owner or competent custodian or keeper.

No person owning, harboring, keeping or in charge of any animal shall cause, suffer or allow such animal to soil, defile, defecate on or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk, or on any public property whatsoever, or on any private property without the permission of the owner of said property. The restriction set forth in this section shall not apply to the portion of the street lying between the curblines, which shall be used to curb such animal under the following conditions:
A. 
The person who so curbs such animal shall immediately remove all feces deposited by such animal by any sanitary and reasonable manner.
B. 
The feces removed from the aforementioned designated area shall be disposed of in a sanitary manner by the person owning, harboring, keeping or in charge of any animal curbed in accordance with the provisions of this chapter.

Any person, firm or corporation who shall violate any provision of this article, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $10 nor more than $50 plus costs of prosecution for the first violation hereof, and shall be subject to a fine of not less than $30 plus costs of prosecution nor more than $1,000 plus costs for each subsequent violation thereof, and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this article continues or each section of this article which shall be found to have been violated shall constitute a separate offense.
