There is hereby established within and for the Township of Upper Gwynedd a fire and water district, the boundary of which shall consist of the boundaries of the Township.

The Commissioners of Upper Gwynedd Township shall annually levy and assess a special fire and water tax in the manner provided for and based upon the assessment for county purposes for general taxation on all surface properties or real estate located in the district hereinabove created which are located within 600 feet of a fire hydrant installed on a water supply line in service on January 1 of the year when such tax is levied and assessed; provided, however, that where an arc of a radius of 600 feet from a fire hydrant does not encompass the entirety of a property held in separate ownership, the tax herein provided for shall be based upon that portion of the total assessment for county purposes which may be fairly allocated to the portion of the property situate within said arc.
The amount of the assessment and levy herein provided for shall be sufficient to reimburse the Township for the cost of all fire hydrant rental, maintenance and other fees and costs paid out by it to the private or municipal suppliers of water to the district and all administrative costs in connection with the collection of the tax herein provided for; provided, however, that in accordance with the provisions of the First Class Township Code such tax shall not exceed two mills per annum.
