GENERAL REFERENCES
Vehicles and traffic — See Ch. 185.
As used in this chapter, the following terms
shall have the meanings indicated:
Includes, without exception, any motor vehicle as to which
one or more of the following conditions exists:
A motor vehicle for which a certificate of junk
has been issued by the Bureau of Motor Vehicles of the Department
of Revenue of the Commonwealth of Pennsylvania.
A motor vehicle whose engine or any essential
or material part thereof has been removed for more than seven days,
except if stored at an automobile repair agency or garage.
A motor vehicle, one or more of whose tires
has been flat or one or more of whose wheels has been removed for
more than seven days.
A motor vehicle bearing no current Pennsylvania
inspection sticker or which does not meet the inspection requirements
of the Commonwealth of Pennsylvania.
A motor vehicle bearing no current registration
or license tag, except if stored on the premises of a licensed automobile
dealer.
A motor vehicle whose doors and windows are
not intact or cannot be securely closed.
A motor vehicle damaged by collision to such
an extent that it is inoperable, except if stored at an automobile
repair agency or garage.
A motor vehicle in such condition or situated
in such circumstances as to cause such vehicle reasonably to appear
to have been abandoned.
A motor vehicle, but not a reproduction thereof, manufactured
more than 25 years prior to the current year, which has been maintained
in and restored to a condition which is substantially in conformance
with manufacturer's specifications.
A self-propelled vehicle, but not a reproduction thereof,
manufactured more than 10 years prior to the current year and, because
of discontinued production and limited availability, determined by
the Pennsylvania Department of Transportation to be a model or make
of significant value to collectors or exhibitors and which has been
maintained in or restored to a condition which is substantially in
conformity with manufacturer's specifications and appearance.
Any motor vehicle, trailer or semitrailer as defined by the
Vehicle Code of the Commonwealth of Pennsylvania.[1]
Any vehicle in or on which is found any of the conditions
specified under the definition of "abandoned vehicle" and has been
registered with the Township of Upper Gwynedd as a vehicle that will
be repaired, properly licensed and inspected within 120 days from
time of registration.

The possession, keeping or storing of an abandoned
motor vehicle on any public street, alley or any other place in the
Township other than in a fully enclosed building is hereby prohibited,
except in a duly licensed junkyard or in an impounding garage or lot
authorized by Upper Gwynedd Township for storage of abandoned motor
vehicles.

Any person or persons, firm or corporation who shall
violate any of the provisions of this chapter, upon conviction thereof,
shall be liable to pay a fine or penalty not to exceed $1,000 plus
costs of prosecution for each and every offense. All fines and penalties
imposed by this chapter are recoverable by summary proceedings before
the Magisterial District Judge, and all suits or actions at law instituted
for the recovery thereof are to be in the name and for the use of
Upper Gwynedd Township, against which the offenses are committed.
In default of payment of any fine or penalty imposed by any Magisterial
District Judge under the provisions of this chapter, the person or
persons so offending may be committed to the Montgomery County Prison
for a period not exceeding 30 days.

Each day a violation is committed shall constitute
a separate offense and shall be punishable as such hereunder.

This section shall not preclude the Township from
any other remedy it may have at law or equity.
