Any person desiring to open the bed of any street in the Town, for the purpose of laying pipes or conduits for water, sewer or other service, or to make repairs thereto, shall first obtain a permit from the Town Manager or designee.
A. 
The applicant for permit shall pay a fee as established in the currently effective Town of Milton Fee Schedule to cover the cost of repairs to openings in the paved surface of the streets of the Town, when repairs to street openings require resurfacing of paved areas. Should the street not be in need of paving, a refund of 1/2 of the relevant fee paid would be given to the applicant upon completion of said work.

B. 
The permit fees required by this section shall not be refundable.

The Town Manager or designee shall receive a fee as established in the currently effective Town of Milton Fee Schedule in advance of issuing permits for street openings. The additional charge for resurfacing the excess of 100 square feet shall be billed to the applicant subsequent to completion of the necessary repairs to paved surfaces.
All money received for permits for street openings shall be deposited with the Treasurer and shall be disbursed as required for other taxes, fees and licenses under the Charter of the Town.
