There is hereby established the Cuba Village Relocation Advisory Assistance Board, which Board shall be charged with rendering all necessary advice, aid and assistance indicated by Section 205 of Public Law 91-646, entitled the "Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970."
The Cuba Village Relocation Advisory Assistance Board shall consist of the executive officer of Cuba Village, the Mayor, the chief administrative assistant to the Mayor, the Village Clerk, and an independent licensed real estate broker having an office and place of business in Cuba Village. Election to the office of Mayor and acceptance of the office of Village Clerk shall automatically qualify said Mayor and Clerk during the term of their offices as members of the Cuba Village Relocation Advisory Assistance Board, and the licensed real estate broker shall be such a broker appointed by the Mayor with the advice and consent of the Board of Trustees of Cuba Village.
The Cuba Village Relocation Advisory Assistance Board and each of its members shall take such steps, furnish such advice and assistance and follow the policies as are established by the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, which actions shall include, but are not necessarily limited to, maintenance of detailed lists of residential housing for sale and rent within the general area of the Town and Village of Cuba, information concerning the general condition of such facilities and rental charges for the same, general data necessary for determination of what persons or parties are in need of relocation assistance and the furnishing of relocation assistance to such persons.
The Cuba Village Relocation Advisory Assistance Board is hereby authorized to certify to Cuba Village, as a proper village charge, relocation expenses as allowed and authorized by Public Law 91-646, and in the event of dispute over the allowance or allowability of such expenses between any displaced person, party or business and a majority of the members of the Cuba Village Relocation Advisory Assistance Board, then and in that event, any such person, party or business aggrieved shall have the right of direct appeal to the Cuba Village Board of Trustees, which Board shall hear and determine and which Board shall act in special session under the Chairmanship of the Deputy Mayor. The Mayor, being the executive officer involved in the initial determination, shall have no right to vote upon the question so appealed.
It is the intention of this chapter to establish a relocation advisory assistance program for Cuba Village which will meet the statutory requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as from time to time amended, and to furnish such relocation advisory assistance for all projects subject to the Act and in accordance with and compliance with the letter and spirit of such law.
