No person shall assemble or demonstrate in any public street in the
Village, except as provided in this chapter.
For the purposes of this chapter, the following terms shall have the
meanings indicated:
A group of 10 or more persons gathering at a specific location or
locations for a period in excess of 30 minutes.
A public display of a feeling (as of approval, sympathy or antagonism)
by three or more persons.
Any street, sidewalk, crosswalk or alley open to the public.
It shall be unlawful for any person to take part in an assembly or demonstration
on any public street in the Village, unless a valid permit has been issued
for said assembly or demonstration by the Village Clerk.
A.
An application for an assembly or demonstration permit
shall be made in writing to the Village Clerk and shall include the following:
(1)
The name, address and telephone number of the person
seeking to conduct such assembly or demonstration.
(2)
If the assembly or demonstration is to be conducted for,
on behalf of or by an organization, the name, principal address and telephone
number of the organization.
(3)
The name, address and telephone number of the individual
authorized to be responsible for the good order and conduct of the assembly
or demonstration.
(4)
The date and time when the assembly or demonstration
will commence and terminate.
(5)
The place of the assembly or demonstration and, if applicable,
the route to be traveled, the starting point and the termination point of
the assembly or demonstration.
(6)
The approximate number of persons and vehicles which
will constitute or otherwise be involved within the Village with the assembly
or demonstration.
B.
Applications for an assembly or demonstration permit
shall be made at least seven days prior to the proposed date of the assembly
or demonstration, unless the applicant can show good cause why the applicant
could not reasonably comply with the seven-day period.
C.
The Village Clerk shall issue the assembly or demonstration
permit upon the applicant's compliance with the provisions of this chapter.
D.
Each assembly or demonstration permit shall designate
the route through which the assembly or demonstration may move or the location
where the assembly or demonstration may be held, and it shall also specify
the width of the roadway to be used and include such conditions as to the
time, place and manner of the demonstration as the Police Department of the
Village of Kings Point may deem necessary to protect the health, welfare and
safety of the residents and others taking part in or in close proximity to
the assembly or demonstration.
E.
The Village Clerk shall issue any decision to reject
an application in writing, stating the grounds for rejecting the application.
Upon the written application of the person who applied for the permit
or any resident of the Village, the Board of Trustees shall, in a timely manner,
review the decision of the Village Clerk to grant or deny the permit and any
conditions imposed therein.[1]
