GENERAL REFERENCES

As used in this chapter, the following terms shall have the meanings indicated:
FIREARM
Includes a shotgun, air gun, air pistol, spring gun or rifle, rifles and pistols of any caliber or any implement which impels with force a pellet or single projectile of any kind (i.e., bow and arrow, slingshot, crossbow, etc.).
A. 
No person shall:
(1) 
Discharge a firearm or longbow in such a way as will result in the shot, slug, load, arrow or other projectile thereof passing over a public highway or any part thereof.
(2) 
Discharge a firearm or longbow within any public recreational area or within or at any publicly owned sewer treatment or water distribution structure.
B. 
The prohibitions contained in Subsection A(2) above shall not apply to:
(1) 
Programs conducted by public schools or public agencies offering instruction and training in the use of firearms or longbow.
(2) 
The authorized use of a pistol, rifle or target range regularly operated and maintained by a police department or other law enforcement agency or by any duly organized membership or nonprofit corporation or gun club or any other sportsman club.
(3) 
The discharge of firearms by law enforcement officers for the performance of their duties.

Any person found guilty of a first offense of this chapter shall be deemed guilty of a violation and shall be fined a sum in the amount set forth in Chapter 122, Article V, § 122-20L of the Code or be imprisoned for a period not exceeding 15 days, or both, and any person found guilty of a second or subsequent infraction of this chapter shall be guilty of an unclassified misdemeanor and shall be subject to imprisonment not exceeding one year or a fine in the amount set forth in Chapter 122, Article V, § 122-20L of the Code, or both.

This chapter will be enforced by the Zoning Administrator, the Building Inspector, the Deputy Building Inspector, the Fire Inspector, the Deputy Fire Inspector and any police agency having jurisdiction within the Town of Wappinger.
