For the purpose of these regulations, certain words and terms used herein are defined as follows. (NOTE: Except where specifically defined herein, all words and terms shall carry their customary meanings.)
BUILDING INSPECTOR
The Building Inspector of the Town of Wappinger, New York, or his duly authorized representative.
BUILDING LOT
Any lot upon which a principal residential or commercial building can be constructed in conformance with the requirements of the Zoning Ordinance.
CONDITIONAL APPROVAL OF FINAL PLAT
The approval of a final plat subject to conditions set forth by the Planning Board in a resolution conditionally approving such plat. Such conditional approval does not qualify a final plat for recording nor authorize issuance of building permits prior to the signing of the plat by a duly authorized officer of the Planning Board and recording of the plat in the office of the County Clerk.
CONSTRUCTION PLANS
The maps and engineering drawings, described in Appendix A, Section A6,[1] of these regulations, accompanying a subdivision plat and showing the specific location and design of improvements to be installed in the subdivision in accordance with these regulations.
EASEMENT
Authorization by a property owner for the use, by another and for a specified purpose, of any designated part of his property.
ENGINEER TO THE TOWN
The Engineer to the Town of Wappinger, New York.
FINAL PLAT APPROVAL
The signing of a final plat by a duly authorized officer of the Planning Board after a resolution granting final approval to the plat or after conditions specified in the resolution granting conditional approval of the plat are completed. Such final approval qualifies the plat for recording in the office of the County Clerk.
LOT
A parcel of land not divided by streets.
OFFICIAL MAP
The map established by the Town Board under § 270 of the Town Law showing the streets, highways and parts theretofore laid out, adopted and established by law and any amendments thereto adopted by the Town Board or additions thereto resulting from the approval of subdivision plats by the Planning Board and the subsequent filing of such approved plats.
OFFICIAL SUBMISSION DATE
The date when a subdivision plat, accompanied by all other information required with the application for subdivision approval, is accepted by the Planning Board at a regular Planning Board meeting and acknowledged by the Board to contain all those documents or information required under these subdivision regulations. No application shall be deemed complete until a determination of no significance has been MADE OR UNTIL A DRAFT ENVIRONMENTAL IMPACT STATEMENT (EIS) HAS BEEN ACCEPTED BY THE LEAD AGENCY AS SATISFACTORY WITH RESPECT TO SCOPE, CONTENT AND ADEQUACY.
PLANNING BOARD
The Planning Board of the Town of Wappinger, New York.
PLAT, FINAL
A drawing, in final form, as described in Section A5 of Appendix A[2] of these regulations, showing a proposed subdivision and containing all of the information required by these or other applicable regulations and all information required to appear on a preliminary plat and the modifications, if any, required by the Planning Board at the time of approval of the preliminary plat of such proposed subdivision and certified by a licensed land surveyor or registered engineer.
PLAT, PRELIMINARY
The preliminary drawing or drawings, described in Section A1 of Appendix A[3] of these regulations, showing the layout of a proposed subdivision, including but not restricted to road and lot layout and approximate dimensions, topography and drainage, all proposed facilities, including preliminary plans and profiles, at suitable scale and in such detail as these regulations require.
RESUBDIVISION
Any change of existing property lines or of property lines shown on a plat approved by the Planning Board and filed in the office of the County Clerk.
ROAD GUARANTY BOND
A bond to guarantee that no defects occur during the term of the bond for those improvements required under the subdivision resolution, and if defects do occur, the bond will guarantee the cost of repair or replacement of the defective construction or improvements for the period of time specified in the bond.
STREET
An existing state, county or Town road or highway, a street shown upon a plat approved by the Planning Board or a street shown on a plat duly filed and recorded in the office of the County Clerk prior to the authority granted to the Planning Board to approve such plats.
STREET, BUSINESS OR INDUSTRIAL
A street which serves or is designed to serve as access to abutting business, commercial or industrial properties.
STREET, COLLECTOR
A street which serves or is designed to serve primarily the function of carrying traffic from local streets to major streets and is designated as such on the Town Development Plan.
STREET, DEAD-END
A street or a portion of a street with only one vehicular traffic outlet.
STREET, LOCAL
A street which serves or is designed to serve primarily as access to abutting residential properties.
STREET, MAJOR
A street which serves or is designed to serve primarily as a route for traffic between communities and/or large areas of the Town and is designated as such on the Town Development Plan.
STREET PAVEMENT
The wearing or exposed surface of the street right-of-way designed to be used by vehicular traffic.
STREET RIGHT-OF-WAY WIDTH
The distance between property lines measured at right angles to the center line of the street.
SUBDIVIDER
Any person, firm, corporation, partnership or association who shall lay out, for the purpose of sale or development, any subdivision or part thereof, as defined herein.
SUBDIVISION
The division of any parcel of land into two or more parts or the combining of two or more parcels of land into one or more parts, regardless of use, with or without the creation of new streets, for the purpose, whether immediate or future, of transfer of ownership or building development, and shall include resubdivision as defined herein. For purposes of these subdivision regulations, any long-term lease for 10 years or more as determined by the aggregate of the initial lease period and any renewal period conferred under the lease agreement shall be deemed a subdivision of land.
TOWN BOARD
The Town Board of the Town of Wappinger, New York.
TOWN DEVELOPMENT PLAN
The comprehensive plan of development for the Town of Wappinger, New York, prepared and adopted by the Planning Board pursuant to § 272-a of the Town Law.
TOWN HIGHWAY SPECIFICATIONS
The standards and specifications adopted by the Town Board for the construction of streets and related subdivision improvements.
ZONING ORDINANCE
The Zoning Ordinance of the Town of Wappinger, New York, and all amendments thereto.[4]
