As used in this chapter, the following terms shall have the
meanings indicated:
The burning of a lighted cigar, cigarette, pipe, or any other
matter or substance which contains tobacco or cannabis as defined
in § 222.00 of the Penal Law, or cannabinoid hemp as defined
in § 3 of the Cannabis Law.
Smoking is prohibited on Village property located at 26 Tibbits
Lane and 2 Governors Lane.
Any person violating the provisions of this article, or any
part thereof, shall, upon conviction thereof, be liable for and forfeit
and pay a fine of not more than $250 for a first offense, $500 for
a second offense, $750 for any offense thereafter.
It is the intent of this article that the Village of Sands Point
opt out of hosting retail cannabis dispensaries and/or on-site cannabis
consumption establishments within its boundaries. This article is
adopted pursuant to New York State Cannabis Law § 131, which
expressly authorizes a village to opt out of allowing retail cannabis
dispensaries and/or on-site cannabis consumption establishments to
locate and operate within its boundaries.
To the fullest extent permitted by law, the Village of Sands
Point hereby opts out of licensing and establishing cannabis retail
dispensaries and/or cannabis on-site consumption establishments within
the Village of Sands Point.
On and after the effective date of this chapter, no governmental
agency shall approve or issue any license or other authority to permit,
establish, or operate any cannabis retail dispensary and/or cannabis
on-site consumption establishment within the Village of Sands Point.
No property or premises in the Village of Sands Point may be
operated or used, in whole or in part, for a cannabis retail dispensary
and/or cannabis on-site consumption establishment, as those terms
are defined in the New York Cannabis Law.
