The term of office of the elective Town Clerk of the Town of Somers shall be four years. Such four-year term shall commence on the first day of January following the first biennial Town election after the effective date of this article.
At the biennial Town election next following the effective date of this article and every four years thereafter, the Town Clerk shall be elected for a term of four years.
This article shall supersede, in its application to the Town of Somers, Town Law § 24, with respect to the term of office of the elective Town Clerk.
This article shall be submitted for approval to the electors of the Town of Somers at an election held not less than 60 days after its adoption.
This article shall take effect immediately upon filing with the Secretary of State after approval by a majority of the electors voting thereon in accordance with the requirements of the Municipal Home Rule Law, § 23.

This article is adopted pursuant to the provisions of the Municipal Home Rule Law of the State of New York.
The term of office of the elected Town Highway Superintendent shall be four years. Such four-year term shall commence as of the first day of January 2004, and shall apply to the person elected to such office at the biennial Town election to be held in November 2003, and to those elected thereafter, provided a proposition submitted pursuant to this article is approved.
This article is adopted subject to a mandatory referendum and shall be submitted for the approval or disapproval of the qualified voters of the Town of Somers at the general election to be held on November 5, 2002, unless a petition is submitted requesting its submission at a special election as provided by law. A proposition in substantially the following form shall be included on the ballot at such election, and the increased term of office shall not take effect unless such proposition is approved by a majority vote of the qualified voters voting thereon:
“Shall the qualified electors of the Town of Somers in the County of Westchester approve Local Law No. 6-2002, adopted by the Town Board of the Town of Somers on August 8, 2002, entitled “A Local Law Increasing the Term of Office of the Highway Superintendent of the Town of Somers From Two (2) to Four (4) Years Effective January 1, 2004.”
This article shall supersede Town Law § 24 in its application to the Town of Somers with respect to the term of office of the Highway Superintendent of the Town of Somers.
This article shall become effective immediately upon filing in the office of Secretary of State after approval by the qualified voters.
