GENERAL REFERENCES
Building permits for properties abutting substandard roads — See Ch. 74, Art. II.

Pursuant to § 280-a, Subdivision 2, of the Town Law, certificates of occupancy affecting properties abutting roads under construction shall be issued in accordance with the following:
A. 
No certificate of occupancy shall be issued with respect to property dependent for access upon a road or street which is under construction pursuant to § 277 of the Town Law, unless the owner of the subdivision continues to comply with all terms and conditions required according to the resolution of the Town Board permitting the issuance of building permits and further that all required curbs shall be installed and that final grading and seeding shall be performed so as to conform with the current standards and specifications of the Town of Somers.
B. 
The owner of the subdivision shall make a written request to the Planning Board stating that the above-mentioned conditions have been met.
C. 
The report of the engineer to the Planning Board shall be furnished to the Superintendent of Highways at least 10 days prior to any action of certification by the Planning Board.
D. 
The Superintendent of Highways shall report to the Planning Board any further provision for safe and adequate operations of the aforesaid roads which he deems advisable, and these shall be included in the Planning Board's report to the Town Board.
E. 
The Town Board resolution authorizing the issuance of a certificate of occupancy will only be effective after all conditions of § 170-119 of Ch. 170, Zoning, have been met.
