The provisions of this article are designed to secure, promote and protect the public health, safety, morals and general welfare of the residents of the Borough of Jenkintown and to reduce the dangers of fire within the school buildings, school buses and enclosed school structures of the Public School District of Jenkintown.
The following words, when used in this article, shall have these stated meanings:
SMOKING
Possession of a cigarette, pipe, cigar or similar object which is ignited or lit and emits smoke.
Except as hereinafter provided in § 149-4 of this article, upon proper posting of "No Smoking" signs, smoking shall be prohibited in all school buildings, school buses and other enclosed structures of the Public School District of Jenkintown.
A. 
"No Smoking" signs. The Fire Marshal, or other designated official, is hereby authorized to order and direct the posting of "No Smoking" signs in each school building, enclosed school structure and in all school buses in which smoking is prohibited. The content, lettering, size, color and location of the required "no smoking" signs shall be subject to the approval of the Fire Marshal.
B. 
Removal of signs prohibited. It shall be unlawful for any person to remove, obscure, deface, mutilate or destroy any posted "No Smoking" sign.
A. 
The Board of School Directors may designate specific safe areas where smoking shall be permitted within the enclosed school structures, which shall be subject to the approval of the Fire Marshal.
B. 
Ashtrays. Where smoking is permitted, noncombustible ashtrays or match receptacles shall be provided at convenient locations within the designated area.
The primary responsibility for the enforcement of this article shall be with the school authorities. The Fire Marshal shall have secondary enforcement responsibility of this article.

Any person who shall violate any of the provisions of this article shall, upon conviction, be sentenced to pay a fine of not less than $25 nor more than $600 and costs of prosecution for each violation or, in default of payment of such fine and costs, to undergo imprisonment for not more than 90 days for each violation.
