A Planning Commission of the Borough of Kutztown is hereby created, to be known as the "Borough Planning Commission."
A. 
Said Borough Planning Commission shall consist of seven persons to be appointed by the Borough Council. The term for each member of the Borough Planning Commission shall be four years, except that any initial term of appointment for a seat on the Planning Commission may be for a period of less than four years, so as not to conflict with § 36-2B of this chapter.
B. 
In no event shall the term of more than two members of the Borough Planning Commission expire in the same year.
C. 
An appointment to fill a vacancy shall only be for the unexpired portion of the then term of the former member of the Borough Planning Commission whose position is being filled.
All members of said Borough Planning Commission shall reside within the Borough of Kutztown and shall serve without compensation.
Said Borough Planning Commission shall perform all the duties and may exercise all the powers conferred upon Borough Planning Commissions by law.
Prior to the adoption of this chapter the Borough of Kutztown had constituted a Planning Commission consisting of five members, pursuant to the previous Chapter 36, all of whose appointments and terms shall remain in place and unaffected by the adoption of this chapter.
