This chapter is adopted pursuant to the authority as set forth in the
Second Class Township Code.[1]

As used in this chapter, the following terms shall have the meanings
indicated:
Grass clippings resulting from the regular mowing of lawns surrounding
residences and commercial structures.
Leaves, garden residues, shrubbery and tree trimmings, and similar
material, but not including lawn clippings.
Any garbage, refuse, waste or other materials, including solid waste,
resulting from the operation of residential, municipal, commercial or institutional
establishments and community activities.
Any individual, partnership, corporation, association, institution,
cooperative enterprise, municipal authority, federal government or agency,
state institution or agency, or any other legal entity whatsoever recognized
by the law as being subject to such rights and duties.
Metals, glass, paper, leaf waste, plastic, lawn clippings and other
materials in a form which are source materials for recycling.
It shall be unlawful for any person to open burn any municipal waste
or recyclable material in the Township of Lower Makefield, unless said open
burning is undertaken by the Fire Department, Police Department, or other
governmental agency as part of an emergency situation. In addition thereto,
the following shall also constitute exceptions to the restrictions against
open burning of municipal waste in the Township:
A.
A fire set to prevent or abate a fire hazard, when set
by or under the supervision of an authorized representative of the Fire Department
or the Township;
B.
Any fire set for the purpose of instructing personnel
in fire fighting when approved by the Chief of the Fire Department;
C.
A fire set to prevent or control disease or pests, when
approved by the Bucks County Board of Health;
D.
A fire set solely for cooking food; and
E.
A fire set solely for recreational or ceremonial purposes.
A.
This chapter shall be enforced by the Township Police
Department and/or the Township Manager and/or his/her designee.
B.
Any person who violates or does not comply with any provision
of this chapter shall be subject to a fine not to exceed $1,000, and each
day shall be considered a separate violation. If the defendant neither pays
nor timely appeals any decision, the Township may enforce a judgment pursuant
to applicable Rules of Civil Procedure.
