No individual shall engage in the business of plumbing in the Township of Lower Makefield, Bucks County, Pennsylvania, unless licensed as a master plumber under the provisions of this Article.
No individual, firm, partnership or corporation shall engage in the business of installing, repairing and altering plumbing unless the plumbing work performed is under the direct supervision of a master plumber.
All examinations shall be conducted by the Regional Cooperation Council Testing Center, P.O. Box No. 94, Fairless Hills, Pennsylvania. All applications for examination shall be filed therewith and the testing fee paid to the Testing Center by the applicant. Licenses will be issued to each person who meets the qualifications thereof and successfully passes the examination given by the Testing Center, Regional Cooperation Council, upon payment of the license fees referred to hereafter.
The Board of Supervisors may issue a temporary license, pending examination, provided that the applicant holds a similar license for an equivalent examination. Such permit shall not be valid for more than thirty (30) days.
Any person desiring to be licensed as a master plumber shall pay an annual fee as set forth by resolution of the Board of Supervisors. Any person desiring to be licensed as a journeyman plumber shall pay a fee as set forth by resolution of the Board of Supervisors. Any person who desires to be apprenticed as a plumber shall pay a registration fee as set forth by resolution of the Board of Supervisors. All fees are to be paid to the Township of Lower Makefield, Bucks County, Pennsylvania.

A person who has been issued a master plumber's license shall execute and deposit with the Township of Lower Makefield a bond in the sum of two thousand dollars ($2,000.); such bond to be conditioned that all plumbing work be performed by the licensee or under his supervision and shall be performed in accordance with the provisions of this code and that he will pay all fines and penalties properly imposed upon him or his agents for violation of this provision of the code. A master plumber's license shall not be valid unless a bond is executed and deposited as herein provided, and also a certificate of insurance to the effect that the master plumber is insured for a minimum of twenty-five thousand dollars ($25,000.) for liability shall be filed with the township.
All licenses issued by the Board shall expire on December 31 of the year in which issued but may be renewed upon payment of fees in the amount provided in §§ 150-5 and 150-6. Expired licenses may be renewed at any time upon payment of the penalty as set forth by resolution of the Board of Supervisors.[2]

The Board may revoke any license if obtained through nondisclosure, misstatement or misrepresentation of a material fact or if a penalty has been imposed on the licensee under § 150-13 of this Article. Before a license may be revoked, the licensee shall have notice, in writing, enumerating the charges against him and is entitled to a hearing by the Board of Supervisors not sooner than five (5) days from receipt of the notice. The licensee shall be given an opportunity to present testimony, oral or written, and shall have the right to cross-examination. All testimony shall be given under oath. The Board shall have power to administer oaths, issue subpoenas and compel the attendance of witnesses. The decision of the Board shall be based on the evidence produced at the hearing and made part of the record thereof. A person whose license has been revoked shall not be permitted to apply within one (1) year from date of revocation.
No person who has obtained a plumber's license shall allow his name to be used by another person either for the purpose of obtaining permits or for doing business or work under the license. Every person licensed shall notify the Board of the address of his place of business, if any, and the name under which such business is carried on and shall give immediate notice to the Board of any change in either.

A certain document, three (3) copies of which are on file with the Secretary of the Township of Lower Makefield, Bucks County, Pennsylvania, being marked and designated as the "BOCA National Plumbing Code, Ninth Edition, 1993" as published by the Building Officials and Code Administrations National, Inc., be and is hereby adopted as the Plumbing Code of the Township of Lower Makefield, Bucks County, Pennsylvania for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code, are hereby referred to, adopted and made a part hereof as if fully set forth in this Article, with the additions, insertions, deletions and changes, if any, prescribed in § 150-11 of this Article.
The following sections are hereby revised as follows:
A. 
Section P-101.1. Insert Lower Makefield Township.
B. 
Section P-113.2. Fee shall be in accordance with Resolution No. 674 or the latest supplement.
C. 
[1]Section P-116.4. This Section is deleted in its entirety and the following is hereby inserted:
Penalties. Any person, corporation, partnership, firm or the like, who or which shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Official or of a permit or certificate issued under the provisions of this Code shall be punishable by a fine of not more than one thousand dollars ($1,000.,) plus court costs and reasonable attorney fees. Each day that a violation continues shall be deemed a separate offense. If the defendant neither pays nor timely appeals the judgment, the township may enforce the judgment pursuant to the applicable rules of civil procedure.

[2]Section P-117.2. This Section is amended to include therein the following provisions:
Unlawful continuance. Any person who shall continue any work in or about the structure after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to prosecution and subject to the penalties as set forth in Section 116.4 of this code. Furthermore, any unlawful continuance of an action or the maintenance of a condition proscribed by this Article is subject to action by the Township in a court of equity in the appropriate jurisdiction to enjoin the unlawful continuance, all of which shall be in accordance with applicable law.
