It shall be unlawful for any person to hold or conduct any circus or carnival at any place within the limits of the Borough without first obtaining from the Borough Manager a permit and paying a permit fee of $100 for each day and evening on which such circus or carnival is to be held.

A. 
Any person, firm or corporation who or which shall violate or fail, neglect, or refuse to comply with any of the provisions of this chapter shall, in addition to any other penalties provided by law, upon conviction before the District Justice, be sentenced to a fine of not more than $200, and the costs of prosecution thereof for each and every offense. Each day on which a violation of any of the provisions of this chapter occur shall constitute a separate and individually prosecutable violation.
B. 
Any person found guilty of or liable for violating any ordinance of the Borough shall be assessed court costs and reasonable attorney’s fees incurred by the Borough in the enforcement proceedings.

At the discretion of the Council, the permit fee may be remitted in the case of a circus or carnival the proceeds of which are applied to purely charitable uses.
