No person or persons shall conduct a business of circuses and carnivals within the Borough of Netcong without having first obtained a license from the Borough Clerk so to do.
An application for a license under this chapter shall contain the following information:
A. 
The date or dates and the hours during which the licensed activity will be conducted.
B. 
A list of all the games, attractions, contests or performances that will be included in the activity to be conducted, a general description of each, and, if not operated by the applicant or his employees, the name and address of the concessionaire or other person operating them.
C. 
A description of the off-street parking and sanitary facilities available at the location at which the activity is to be conducted.
D. 
Appropriate evidence that the applicant has made adequate provision for the payment of workmen's compensation to any of his employees who shall be injured, as required by N.J.S.A. 34:15-71.
The application shall be referred by the Borough Clerk to the Chief of Police, who shall make such investigation of the applicant and of the premises where the activity is to be conducted as he shall deem to be necessary in the interest of public health and safety.
The Chief of Police shall report his findings to the Mayor and Council for consideration. If the Mayor and Council shall thereupon approve the application, the Borough Clerk is hereby authorized to issue any such license upon the payment by the applicant of the proper fee therefor as hereinafter provided.
Every license shall remain in force and be valid only for the time therein expressed, and shall apply only to the person or persons to whom granted and shall not be transferable. A license shall be subject to revocation by the Chief of Police for violation of its terms or for the conduct of the licensed activity in a manner inimical to public health and safety.
Any person to whom such license is granted as herein provided is hereby required to exhibit such license whenever called upon so to do.
The license fees under this chapter shall be as follows:
A. 
Circuses: $75 per day.
B. 
Carnivals: $75 per day.

Any person, firm, or corporation violating any of the provisions of this chapter shall be subject to such penalties as are provided for in Article I of Chapter 1 of the Code of the Borough of Netcong.
