A. 
Mandatory restrictions. All residents, tenants and businesses using water supplied by the Borough of Pemberton shall observe mandatory water use restrictions as follows:
(1) 
The water use restrictions are mandatory during the entire year, January through December.
(2) 
Outdoor use for lawn, garden, shrub and any other vegetation watering, car and any other mobile equipment washing, and washing of driveways, sidewalks, buildings and equipment shall be restricted to alternate days, which usage is allowed on even-numbered days for those residents or businesses whose dwelling, building or box number is even and on odd-numbered days for those residents or businesses whose dwelling, building or box number is odd. In any month with 31 days, the 31st day of the month is to be considered an open watering day and lawns may be watered.
(3) 
Automatic shutoff nozzles shall be used on hoses used for outdoor washing (vehicles, boats, windows, etc.).
(4) 
The use of public water for irrigation shall be prohibited during the hours of 9:00 a.m. and 6:00 p.m. in accordance with the odd-even schedule as set forth in Subsection A(2) above.
(5) 
Swimming pools are permitted to be filled or topped off in accordance with the odd-even schedule set forth in Subsection A(2) above.
B. 
Exceptions to the odd-even watering restrictions are:
(1) 
The watering of lawns by a commercial enterprise engaged in the installation or repair of sprinkler systems is allowed on any day, if necessary, to test a customer's newly installed or newly repaired sprinkler system.
(2) 
Plants, trees, and shrubs may be watered immediately after planting or replanting.
(3) 
Daily watering of newly sodded lawns or a newly seeded lawn is allowed for the first 30 days after planting or seeding. Documentation of the date of seeding or sod laying shall be provided upon the request of the Code Enforcement Officer.
(4) 
Use of water from private wells, rain storage tanks or similar water sources that are not served by the Borough of Pemberton.
All renovated or newly installed automatic irrigation or sprinkler systems must have operating rain sensors incorporated in the system.
The water use restrictions imposed pursuant to this chapter shall be enforced by the Code Enforcement Officer.
Failure to comply with the required water conservation measures set forth in this chapter shall be punishable by a fine of $100 for the first offense, $250 for the second offense, and $500 for the third and each additional offense.
