[Adopted 4-13-1989 by Ord. No. 5-1989]
Pursuant to N.J.S.A. 40A:9-136, there is hereby
created the position of City Administrator.
The City Administrator may be removed by a two-thirds
vote of the governing body. The resolution of removal shall become
effective three months after its adoption by the governing body. In
accordance with N.J.S.A. 40A:9-138, the governing body may provide
that the resolution of removal shall have immediate effect; provided,
however, that the governing body shall cause to be paid to the Administrator
forthwith any unpaid balance of his/her salary for the next three
calendar months following adoption of the resolution.

The City Administrator shall be chosen on the
basis of his/her executive and administrative abilities and qualifications
with special regard as to education, training and expertise in governmental
affairs and subject to any further qualifications the Mayor and City
Council may establish in its advertising for the position. The person
selected shall not be required to be a resident of the City of Somers
Point.

Any vacancy in the position of City Administrator
shall be filled by appointment by the Mayor.
A.
The City Administrator shall, under the supervision
and control of the Mayor and City Council and to the extent not prohibited
by law, have the following duties and responsibilities:
(1)
To serve as the principal administrative officer representing
the Mayor and City Council.
(2)
To supervise the administration of all departments
and offices. The Mayor and Council shall deal with the department
heads and employees only through the Administrator and shall not give
orders or direction to city personnel except through him, provided
that nothing herein shall be construed to abrogate the Mayor's statutory
administrative authority when he has not delegated it nor to prevent
the Council from conducting investigations into the conduct of any
officer or department or any matter relating to the welfare of the
city, by committees of its own members or of citizens designated for
such purposes.

(3)
To represent the city in its relationships with the
federal, state and county governments and to other municipalities
and to evaluate the city's interest in contracts, franchises and other
business transactions as assigned by the Mayor and City Council.
(4)
To keep the Mayor and City Council informed of the
financial condition of the city and make such reports thereon as required,
and to prepare annually a comprehensive report on the financial condition
of the city.
(5)
To study the administrative and other operations of
the city and make recommendations for plans and programs to meet the
changing needs of the city.
(6)
To receive and reply to inquiries and complaints concerning
city business and to provide information and assistance in respect
thereto.
(7)
To attend all meetings of the City Council as required.
(8)
To establish and maintain sound personnel practices
and maintain appropriate records of all employees. Except with respect
to department heads, he/she shall have authority for hiring and for
initial disciplining of all city employees. In conjunction with the
Department Council Chairperson, the Administrator shall have the authority
to recommend to the Mayor and City Council the further disciplining
of all city employees.

(9)
To recommend the nature, location and extent of public
improvements and to coordinate the execution of the same when authorized
by the Mayor and City Council.
(10)
To implement and enforce the policies of the
Mayor and City Council with respect to the compiling and release of
public information.
(11)
To consult with the Mayor and City Council on
the preparation of the tentative budget, recording changes, additions
and deletions thereto, and to submit final recommendations in the
form required by law, together with an analysis of the various items
of expenditure and revenue and such explanatory comments as may be
required.
(12)
To maintain a continuing review and analysis
of budget operations, work progress and the cost of municipal services.
(13)
To supervise the disbursement of all city funds
before submitting to the Mayor and City Council for final approval.
(14)
To analyze the cash needs of the city and recommend
to the Mayor and City Council the prudent investment of such funds
as temporarily may be in excess of the amounts needed to meet city
obligations.
(15)
To supervise and continually review the city's
insurance program.
(16)
To assist the Mayor and City Council in negotiating
contracts for the city as authorized by and subject to the approval
of the Mayor and City Council.
(17)
To act as liason on behalf of the city with
all utility companies serving any portion of the city to be sure that
such utilities are providing adequately for the needs of the residents
of the city.
(18)
To assure that the provisions of all franchises,
leases, permits and privileges granted by the city are complied with.
(19)
To require such department to maintain adequate
inventory records of all equipment and materials owned and used by
the city and to arrange for the disposal of all inadequate or obsolete
materials when directed to do so by the Mayor and City Council.
(20)
To assist the residents of the city in matters
within his/her jurisdiction, to maintain a record of complaints submitted
to him/her for his/her attention and to take proper steps to remedy
the causes for such complaints.
(21)
To keep the Mayor and City Council currently
informed of all matters within his/her jurisdiction by such reports,
verbally or in writing, as he/she deems advisable or as may be requested
by the Mayor and City Council and to submit an annual written report
of his/her work accomplished at the request of the Mayor and City
Council for the benefit of the public, which report will also establish
particular goals and objectives for the following year.
(22)
To perform such other duties as may be assigned
to him/her from time to time by the Mayor and City Council.
(23)
To perform the functions of contracting agent
as defined in N.J.S.A. 40A:11-2(3) on behalf of the city.

B.
Nothing in this section shall extend authority to
the Administrator to administer, supervise, terminate, hire or discipline
Police Department personnel. The City Administrator shall have the
final authority on all matters of business related activities of the
Police Department, including purchasing and finance.

The City Administrator shall devote full time
to the interests of the city. The Mayor and City Council reserves
the right at any time to set specific hours for the Administrator
by resolution.
Nothing in this article shall derogate from
or authorize the City Administrator to exercise the powers and duties
of the elected or appointed officials of the city.
