There is hereby created and established in the City of Somers Point a Police Department, to be known and designated as the "Police Department of the City of Somers Point."[1]

As soon as practicable after the effective date of this Article, the city shall prescribe and establish rules and regulations respecting such Department and for the better government and discipline thereof; provided, however, that until such rules and regulations have been established, the rules and regulations of the former Police Department of this city shall remain in full force and effect or said city may, in its discretion, prescribe, establish and adopt the rules and regulations of the former Police Department of this city as and for the rules and regulations of the Police Department hereby established, with such amendments or supplements thereto, if any, as said city may deem necessary or advisable for the better government and discipline of the Police Department herein created.[1]

A. 
Preference in appointment of members of former Police Department. The members of the former Police Department holding any prior office, position or employment therein prior to the adoption of this Article shall have a preferential right to appointment in the Police Department created by this Article and to retain in said Department the same rank or status as nearly as possible as that held by them in the old Police Department of this city, but subject to the provisions of Title 11 of the Revised Statutes of this state.[1]

B. 
Continuance of employment of members of former Police Department. All policemen, clerks and other employees, including the Chief of Police, the Captains and Sergeants of Police of the old Police Department of this city, are hereby continued in their respective employments, positions and offices pursuant to the terms of this Article and at the same salaries paid to them prior to the adoption of this Article.
