Editor's Note: This local law also repealed former Ch. 205, Village Parks, adopted 8-18-1986 as Ch. 48, Art. I, of the 1968 Code, as amended.
The following five designated areas owned by the Village may be utilized by members of the public for park purposes as defined herein and upon the terms and conditions herein provided:
A. 
Derby Park: located generally between William Street and Coleman Avenue.
B. 
Paris Park: located generally behind Village Hall between Clark Street and Locust Street.
C. 
J. Walter Juckett Park: located within the bounds of the Route 4 traffic circle in the downtown area of the Village.
D. 
Wall Street Pond: located easterly of Wall Street and consisting of a pond supplied by stormwater drainage from the former Village reservoir area.
E. 
Grace Park: located generally westerly of Wall Street and bounded northerly by the stream leading from the Wall Street Pond.
A. 
No alcoholic beverages and no glass containers shall be allowed in any of the Village parks.
B. 
No dogs, cats, or other pets or animals shall be allowed in any of the Village parks.
C. 
No bicycling or skateboarding shall be allowed in any of the Village parks.
D. 
No activity which is determined in the sole discretion of the Mayor to be potentially hazardous to the safety, health, or well-being of the public shall be allowed in any of the Village parks.
E. 
No profanity, obscene language, or disorderly conduct shall be allowed in any of the Village parks.
F. 
No vendors of any products, including, but not limited to, food and beverages, shall be allowed in any of the Village parks unless each vendor submits to the Village an application for approval. Said application shall identify the vendor and shall detail the nature of the product to be sold. The Mayor may impose conditions to the issuance of any vendor approval, including insurance, fees, and other restrictions deemed appropriate.
G. 
No fireworks shall be discharged in or near any of the Village parks unless a separate application to conduct a fireworks display has been submitted and approved by the Mayor. The Mayor shall have the sole discretion to either deny said application for a fireworks display, or to approve same with restrictions and conditions deemed appropriate in the sole discretion of the Mayor.
H. 
All areas of the Village parks shall be closed to the public during the hours of 12:00 midnight to 6:00 a.m., except for events and activities specifically authorized by a permit issued pursuant to Chapter 144 of the Code.
I. 
The Village Board may establish a dress code setting forth the standards of proper attire to be worn by persons utilizing the park areas. In this regard and at a minimum, persons utilizing the park areas shall wear suitable covering for the feet and torso. Clothing exhibiting profane or obscene language, design or photographs shall be prohibited.
J. 
No smoking shall be allowed in the park areas.
K. 
No areas, structures, buildings or facilities in any of the park areas shall be defaced or damaged.
L. 
Users of the park areas shall not deposit any debris, garbage or other trash upon any of the park areas.
M. 
The Village Board of Trustees may establish by resolution additional rules and regulations governing activities and conduct in any of the park areas and all other public areas within the Village. Said rules and regulations may be conspicuously posted in locations of the park areas as determined by the Mayor or the Superintendent of Public Works. Said rules and regulations shall also be on file with the Village Clerk.
A. 
The use of the playground equipment designated as the ARK shall be restricted to children under the age of 10 years who are supervised and under the control of a parent or adult chaperone.
B. 
Notwithstanding § 205-2H, park hours for Derby Park shall be those hours conspicuously posted in the park at locations established by the Mayor or Superintendent of Public Works. No persons shall enter Derby Park at any other times.
A. 
No person shall sit, stand, walk or otherwise enter the facility comprising the fountain. No objects, debris or trash shall be deposited in the fountain.
B. 
No person shall, sit, stand, or climb upon any monument or public memorial located in the park. Defacing of any monument or public memorial is prohibited.
C. 
No person shall sit or stand on the back of any park bench.[1]

Due to the hazardous condition caused by the flow of water through Wall Street Pond, the icing of Wall Street Pond during the winter months may not be safe for pedestrian access. Therefore, any pedestrian use of the iced surface of Wall Street Pond, whether for skating, hockey or otherwise, is prohibited.
A. 
Any person violating any of the conditions and restrictions pertaining to the use of Village parks shall be subject to immediate expulsion from the park.
B. 
Any person violating any of the conditions and restrictions pertaining to the use of the Village parks shall be subject to a penalty not exceeding $250 or imprisonment for a period not exceeding 15 days, or both, for conviction of a first offense; for conviction of a second offense within a period of three years of the first offense, such person convicted of violating this chapter shall be subject to a penalty of not less than $250 nor more than $500 or imprisonment for a period not to exceed 30 days, or both; and upon conviction for a third offense committed within a period of five years of the first offense, such person shall be subject to a penalty of not less than $500 nor more than $750 or imprisonment for a period not to exceed 60 days, or both.
