Whereas the Borough of Moosic has heretofore established a Police Department and has also designated one of the members thereof as Chief of Police, and has designated other members thereof to serve as Assistant Chief of Police, and patrolmen; and providing particularly for the appointment of auxiliary police and part-time police, the Borough of Moosic desires to continue said Department and the positions therein, and to expand said positions and activities.
The existing Police Department is hereby recognized and hereby reestablished in and for the Borough of Moosic. Further, all persons now appointed to positions within the Police Department are recognized as such without further Council action required.

The Borough Council shall appoint the Chief of Police pursuant to the Borough Code and provisions of the Borough Civil Service Rules and Regulation. The Chief of Police shall be the Chief Executive Officer of the Police Department. He shall be under the direct supervision of the Mayor and shall possess such duties as prescribed in the Borough Code.

Subordinate to the Chief of Police, in the Police Department, the following classifications are hereby established: Assistant Chief of Police, one Captain position, three Sergeant positions, and patrolmen, or those of such classification to which Council shall at any specific time have appointed one or more police officers. The priority of authority among such subordinate classifications shall be in the order listed above. The number of persons to serve in each of such subordinate classifications on a full-time and/or part-time basis shall be as determined by the Borough Council from time to time.
Full time members to the Police Department shall be appointed by Borough Council in accordance with the manner as set forth in the Act of February 1, 1966, P.L. (1965) 1656, 53 P.S. § 46184.
All members of the Police Department of the Borough of Moosic, auxiliary police, and special school police shall, before they enter upon their duties, be sworn in by the Mayor.
The compensation of the Chief of Police shall be as determined by the Borough Council from time to time. The compensation of other full-time members under § 48-9 of this article shall be as determined by Borough Council from time to time, subject to collective bargaining procedures as stipulated by law (Act III of 1968). The compensation of part-time police shall be as determined by Borough Council by resolution.
A. 
Part-time police authorized. The Borough Council hereby declares its intent to create and hereby creates part-time police officers. Such appointment is made in accordance with the Act of February 1, 1966, P.L. (1965) 1121, 53 P.S. § 46121.
B. 
Appointment of part-time police. Part-time members of the Police Department shall be appointed by Borough Council in accordance with the manner as set forth in the Act of February 1, 1966, P.L. (1965), 1656, 53 P.S. § 46184.
C. 
Powers of part-time police. Part-time police, while on active duty, shall have the same powers as the full-time police officers of the Borough of Moosic.
D. 
Duties of part-time police. Part-time police, when on active duty, shall have the same duties as the full-time police officers of the Borough of Moosic.
A. 
Auxiliary police authorized. The Borough Council hereby declares its intent to create and hereby creates an auxiliary police force to supplement the regular police force in times of need.
B. 
Appointment of auxiliary police. The Chief of Police shall nominate persons as auxiliary police who have satisfactorily completed such training as the Chief may prescribe and/or may be prescribed by law. All such persons so nominated shall, before they enter upon their duties, be approved by the Mayor and a majority of Borough Council, and be sworn by the Mayor.
C. 
Term of service of auxiliary police. Auxiliary police shall serve at the pleasure of the Chief of Police.
D. 
Powers of auxiliary police. Auxiliary police, when on active duty, shall have the same powers as the regular police officers of the Borough of Moosic, and shall perform such other duties as may be assigned to them by the Chief of Police. Auxiliary police officers, when on active duty, are hereby designated as peace officers of the Borough of Moosic. The powers herein conferred may be exercised by auxiliary police officers only after they report for active duty and until they are relieved from duty.
E. 
Duties of auxiliary police. The Chief of Police, under the direction of the Mayor, shall have charge of all auxiliary police, and shall have supervision of auxiliary police in the exercise of their duties, powers and authorities. Auxiliary police shall perform such duties as may be assigned to them by the Chief of Police. These duties include, but are not limited to, aiding and supplementing the regular police force in routine duties, providing police protection at athletic events, serving as park police officers or guards, acting as crossing guards and such other assignments as the Chief of Police may determine.
F. 
Compensation for auxiliary police. The compensation for persons serving as auxiliary police shall be as determined by Borough Council from time to time.
A. 
Appointment of special school police. The Borough Council may appoint special school police.
B. 
Duties of special school police. Special school police shall have the duty of controlling and directing traffic at or near schools and shall be in suitable and distinctive uniforms and shall display a badge or other sign of authority. Such appointments shall be in accordance with the Act of February 1, 1966, P.L. (1965), 53 P.S. § 46127.
C. 
Powers of special school police. Special school police are vested with all the powers of local police officers and while on duty shall be under and subject to the direction of the Mayor.
D. 
Term of service of special school police. Special school police shall serve at the pleasure of the Borough Council and shall not come within the civil service provision of the Borough Code[1] and shall not be entitled to participate in any police pension plan or plans now in effect or hereafter effective.

E. 
Compensation of special school police. The compensation for persons serving as special school police shall be fixed by Borough Council and shall be jointly paid by the Borough Council and the Board of School Directors, in a ratio to be determined.
Whenever any member of the Police Department reaches 62 years of age, he shall be retired from active duty in the Police Department and placed on inactive status. Any such member of the Police Department may be subject from time to time as a police reserve in case of riot, tumult or preservation of the public peace until unfitted for such service, when he may be finally discharged by reason of age or disability. Any regular salaried member of the regular police force who is retired from active duty under the provisions of this article shall be eligible to receive any pension or retirement benefits for which he qualifies under the Borough Code and as determined by the provisions of a duly enacted retirement plan or pension fund. While on duty as a police reserve, such person shall be paid as wages, in addition to his regular pension, such sum as Council may in each case determine but only out of the general fund of the Borough.
