Every owner or resident of any lot or parcel
of land abutting upon any of the streets of the Borough shall keep
and maintain that portion of the sidewalk and gutter immediately in
front of such lot or parcel or land cleaned and cleared of all obstructions.
Whenever any snow, slush or other obstructions have accumulated on
such sidewalk, or in such gutter, it shall be the duty of every such
person to remove the same. Any person neglecting or refusing to do
so within 12 hours after such obstruction shall have occurred shall
be liable for the penalty set forth in this article.
It shall be unlawful for any owner or resident
of any lot or parcel or land abutting upon any street in the Borough
of Moosic to deposit or throw or discard snow, slush or other obstructions
into the public rights-of-way.
Any person, owner or resident of the Borough
of Moosic violating any provision of this article shall, upon conviction
before a local District Justice, be sentenced to pay a fine of not
more than $600, plus costs and costs of prosecution, for depositing
or throwing or discarding snow, slush or other obstructions into the
public rights-of way; further, in default of payment of such fine,
fee and costs of prosecution, to be imprisoned for not more than 30
days; provided, further, that each day's violation of any of the provisions
of this article shall be constituted as a separate offense.
