The International Property Maintenance Code of 2006 prepared by the International Code Council Inc., be and is hereby adopted as the Property Maintenance Code of the Township of Bethel with the following amendments:
A. 
Section 106.3 is hereby amended to read:
106.3 Violation penalties. Any person failing to comply with the notice of violation or order served in accordance with Section 107 shall be deemed guilty of a summary offense, and the violation shall be deemed a strict liability offense. If the notice of violation is not complied with, the Township shall institute the appropriate proceedings at law or in equity to restrain, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the structure in violation of the provisions of this code or of the order or direction made pursuant thereto. Any action taken by the authority having jurisdiction on such premises shall be charged against the real estate upon which the structure is located and shall be a lien upon such real estate.
B. 
A new Section 301.4 is hereby added to read as follows:

301.4. Rental permit. Anyone who rents, leases or lets any residential property, that is not owner-occupied, either for money or other monetary compensation, is required to obtain a rental permit. A rental application form, supplied by the Township, is required to be completed and returned to the Township along with the appropriate fees established from time to time by resolution of the Board of Supervisors.
The owner or agent of each rental property is required to reregister the property, and have said property inspected, each time there is a new tenant. Each rental property is required to be inspected for compliance with the currently adopted codes. A rental permit is required before the dwelling may be tenant occupied.
No rental dwelling shall be occupied by more than four unrelated persons.
Exceptions:
1.
Immediate family; similar but not limited to, parents, spouses, siblings (adopted or legal guardian).
2.
Existing rental properties are required to register only and must fully comply with the terms of this chapter when a new tenant occupies the property.
C. 
A new Section 301.5 is hereby added to read as follows:

301.5 Information form for commercial properties. All commercial (nonresidential) properties either owner-occupied or rented, leased or let, shall be inspected every calendar year. A calendar year is January 1 to December 31.
An information form, supplied by the Township, is required to be completed and returned to the Township, with appropriate fees established from time to time by resolution of the Board of Supervisors. A contact person shall be named and be able to respond in a timely manner to any emergency.
The information form shall be completed and returned to the Township no later than March 1 of each calendar year. All inspections must be completed by the end of the calendar year.
D. 
Section 302.4, Weeds, is hereby amended to read:
302.4 Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of eight inches in height. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs; provided, however, this term shall not include cultivated flowers and gardens.
E. 
Chapter 6, Section 602.3, Heat supply, shall be amended to read:
602.3 Heat supply. Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guestroom on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat at all times to maintain a temperature of not less than 68° F. (20° C.) in all habitable rooms, bathrooms, and toilet rooms.
F. 
Section 602.4, Occupied work spaces, shall be amended to read:
602.4 Occupied work spaces. Every owner or operator of any building with employee work areas shall supply heat at all times to maintain a temperature of not less than 68° F. (20° C.) in all work areas used by employees.
