It shall be unlawful and it is hereby prohibited for any person, persons, firm or corporation, to store, sell, offer for or expose for sale, or have in their possession with intent to sell, or with intent to use within the limits of the Township of West Lampeter, any air rifle or air pistol (commonly known as a "B-B gun"), slingshot, switchblade knife, the blade of which can be opened or released by mechanical means, or any similar device or devices.
The Township police or any peace officer is hereby authorized to seize, remove and destroy any air rifle or air pistol (commonly known as a "B-B gun"), slingshot, switchblade knife, the blade of which can be opened or released by mechanical means, or similar device, which is used or discharged within the Township of West Lampeter or which shall be held and possessed in violation of this chapter. Provided, however, that the sale, use or possession of switchblade knives as herein defined shall not be deemed to prohibit the use of knives falling within the above description which are designed primarily for use in hunting or fishing when sold to and carried and used by a duly licensed hunter or fisherman for such purposes.
The provisions of this chapter shall not apply to air guns or pistols, gas-powered guns or pistols having rifled barrels and being commonly used for target practice and the shooting of small game; provided, however, that such articles shall not be used or discharged in violation of the hunting laws of the Commonwealth of Pennsylvania or less than 250 yards from any building used or suitable for human occupancy.
Any person or persons, firm or corporation violating any of the provisions of this chapter shall be guilty of a summary offense and upon conviction thereof before any District Justice shall be subject to a fine or not more than $100 or imprisonment in the Lancaster County Prison for not more than 30 days, or both.
