GENERAL REFERENCES
Municipal swimming pools — See Ch. 175.
Plumbing standards — See Ch. 558.
As used in this chapter, the term "swimming pools" shall not include swimming or wading pools established or maintained upon any premises by any individual for his own or his family's use or guests of his household.
The "Swimming Pool Code of New Jersey - 1970," together with any subsequent deletion, amendment or supplement thereto, is hereby adopted. A copy of said code is annexed hereto and made a part hereof without the inclusion of the text of said code herein. The copy of said code annexed hereto is plainly marked to indicate what portions of said code are intended to be adopted and which portions are intended to be deleted, amended or supplemented.
Any section or subsection of said Swimming Pool Code of New Jersey - 1970, which is not specifically referred to herein and hereby deleted, amended or supplemented is hereby accepted and made part of the Swimming Pool Code for Toms River Township.
The changes and exceptions effective in Toms River Township to said Swimming Pool Code of New Jersey - 1970, are as follows. (Section references hereinafter set forth are to sections as set forth in said Swimming Pool Code of New Jersey - 1970.)
A. 
In Paragraph (b) of Subsection 2.11, Hearings, of Section 2, Administration, the word "seven" and the figure "7" in the first sentence shall be amended to read "20."
B. 
Subsections 3.4, Size; 3.5, Diving Area Design; 3.6, Bottom Slope; 3.7, Walls; and 3.8, Marking, of Section 3, General Layout and Design, are hereby deleted.
C. 
Subsection 3.12, Decks and Walkways, of Section 3, General Layout and Design, is hereby amended to read as follows:
3.12 DECKS AND WALKWAYS
Any deck which adjoins or extends around the swimming pool shall be sloped away from the pool to drain and shall have a nonslip surface. Deck drains shall not be connected to the recirculation system of gutters, except as permitted in Section 3.10.
D. 
Subsection 3.13, Ladders and Stairs, of Section 3, General Layout and Design, is hereby amended to read as follows:
3.13 LADDERS AND STAIRS
If steps are inserted in the walls of the swimming pool or if step holes are provided, they shall be of such design that they may be cleaned readily and shall be arranged to drain into the pool to prevent the accumulation of dirt thereon.
E. 
Subsection 3.16, Lighting and Electrical Requirements, of Section 3, General Layout and Design, is hereby deleted.
F. 
Section 4, Diving Stands and Boards, is hereby deleted.
G. 
Subsections 5.1, Layout, and 5.2, Depth Requirements, of Section 5, Wading Pools, are hereby deleted.
H. 
Subsection 10.1, Layout, of Section 10, Dressing Rooms and Bathhouses, is hereby deleted.
I. 
Subsection 14.3, Lifeguard Platform, of Section 14, Supervision and Maintenance, is hereby deleted.
J. 
Paragraph (f) of Subsection 14.4, Personal Regulations, of Section 14, Supervision and Maintenance, is hereby deleted.
K. 
Subsection 15.1, Analysis, of Section 15, Bathing Water Quality, is hereby supplemented and the following shall be added as a paragraph after the last sentence of this subsection:
All said chemical and bacteriological analyses of swimming pool waters shall be performed by a laboratory approved by the State Department of Health.
L. 
Subsection 15.6. Chemical Quality, of Section 15, Bathing Water Quality, is hereby supplemented and the following shall be added as a paragraph after the last sentence of the first paragraph of this subsection:
A log or other record system shall be kept and entries shall be made therein of the results of said testing for free chlorine residuals and pH values. Said entries shall be made immediately upon receiving the results of said testing. All such logs and records shall be made available for inspection upon demand by any official or employee of the Board of Health.
A. 
There shall be a charge of $25 which must accompany each letter or application for a license or permit to be issued by the Board of Health pursuant to Subsection 2.2, Procedure for Obtaining Approval to Locate and Construct, of Section 2, Administration, of the Swimming Pool Code of New Jersey - 1970, heretofore made a part of this chapter.
B. 
There shall be a charge of $10 which must accompany each letter or application for a license or permit to be issued by the Board of Health pursuant to Subsection 2.3, Procedure for Obtaining a License or Permit to Alter, of Section 2, Administration, of the Swimming Pool Code of New Jersey - 1970, heretofore made a part of this chapter.
C. 
Each application for a license or permit to be issued by the Board of Health must be made pursuant to Subsection 2.7, Procedure for Obtaining License or Permit to Operate, of Section 2, Administration, of the Swimming Pool Code of New Jersey - 1970, heretofore made a part of this chapter. There shall be a charge of $50 which must accompany each application for a seasonal license or permit, and there shall be a charge of $75 which must accompany each application for a year-long license or permit. A seasonal license or permit approval under said Subsection 2.7 shall take effect on the first day of April and shall expire on the first day of October of the same year. A year-long license or permit approved under said Subsection 2.7 shall expire annually on the first day of April of each year. Each year when an application for a year-long license or permit is submitted, and each time when an application for a seasonal license or permit is submitted, it must be accompanied by the required fee.

Editor's Note: This ordinance further provided that any holder of certificates, permits or licenses on the effective date of this chapter shall be allowed to hold the same without additional fee until its expiration date. Any certificate, permit or license issued or renewed after the effective date of this chapter shall be governed by the provisions of this chapter.
Each violation of any section, subsection or provision of this chapter or code established herein shall subject the violator, upon conviction thereof, to a penalty of a fine of not less than $15 nor more than $500. Each day particular violation continues shall constitute a separate offense.
Three copies of the said Swimming Pool Code of New Jersey - 1970, have been placed on file in the office of the Secretary of the Board of Health upon the introduction of this chapter and will remain on file there until final action is taken on this chapter for use and examination by the public. Said copies have been plainly marked to indicate what portions of said code are intended to be adopted and which portions are intended to be deleted, amended or supplemented.
