Whenever any words and phrases are used in this chapter the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the Township.
7-3.1. 
 Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
7-3.2. 
 Parking prohibited during state of emergency.
a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fire, or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and menace to the safe and proper regulations of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
7-3.3. 
 Parking prohibited at all times on certain streets. No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I attached to and made a part of this chapter.
7-3.4. 
 Parking prohibited during certain hours on certain streets. No person shall park a vehicle between the hours specified in Schedule II of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule II attached to and made a part of this chapter.
7-3.5. 
 Stopping or standing prohibited during certain hours on certain streets. No person shall stop or stand a vehicle between the hours of the day and on the days of the week specified in Schedule III, upon any of the streets or parts of streets described in Schedule III attached to and made a part of this chapter. If no specific hours of the day or days of the week are specified in Schedule III, the prohibition shall apply 24 hours per day and seven days per week.
7-3.6. 
 Parking time limited on certain streets. No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV attached to and made a part of this chapter.
7-3.7. 
 Parking of certain vehicles restricted.

a. 
No person shall park a truck, tractor, trailer, dumpster, bus, school bus, vehicle used for the transportation of passengers for hire or construction equipment of any kind on any street of the Township within a residentially zoned area at any time of the day. There shall be no exception for this concerning the placement of a dumpster upon a street but the remaining enumerated above shall not be prohibited from parking while being actively used in connection with the delivery, pickup, loading and unloading of individuals and/or equipment.
b. 
The provisions of this subsection shall not apply to a truck or vehicle less than 25 feet in length.
c. 
The provisions of this subsection shall be enforced by the Police Department of the Township.
d. 
For the purpose of this subsection, unless another meaning is clearly apparent, the class of vehicles enumerated shall be defined as in Title 39 of the Revised Statutes of New Jersey.
7-4.1. 
 Trucks over four tons excluded from certain streets. Trucks over four tons gross weight are hereby excluded from the streets or parts of streets described in Schedule V except for the pick up and delivery of materials on such streets. Schedule V is attached to and made a part of this chapter.
The streets or parts of streets described in Schedule VI attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.
7-6.1. 
 Through streets. Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VII attached to and made a part of this chapter are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street except where yield signs are provided for in the designations.
7-6.2. 
 Stop intersections. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule VIII attached to and made a part of this chapter are hereby designated as stop intersections. Stop signs shall be installed as provided therein.
7-6.3. 
 Yield intersections. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule IX attached to and made a part of this chapter are hereby designated as yield intersections. Yield signs shall be installed as provided therein.
The locations described in Schedule X attached to and made a part of this chapter are hereby designated as loading zones.
The locations described in Schedule XI attached to and made a part of this chapter are hereby designated as taxi stands.
The locations described in Schedule XII attached to and made a part of this chapter are hereby designated as bus stops.
7-10.1. 
  Left turn prohibition. No person shall make a left turn at any of the locations described in Schedule XIII attached to and made a part of this chapter.
7-10.2. 
  U-turn prohibition. No person shall make a U-turn at any of the locations described in Schedule XIV attached to and made a part of this chapter.
7-10.3. 
  Restricted travel on portion of Redwood Road.

a. 
Restricted travel is hereby implemented to provide for restricted travel along a portion of Redwood Road as set forth in Schedule XV which is attached and made a part of this chapter.
b. 
Exceptions. This restriction shall not apply to emergency vehicles responding to an emergency. Said vehicles shall be permitted to access through said points of closure.
c. 
Signage advising of NO OUTLET and of the appropriate closures along Redwood Road will be posted in accordance with the current Manual on Uniform Traffic Control Devices standards.
d. 
Any person who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $250. For a second offense, upon conviction thereof, pay a fine of not less than $500 and/or be imprisoned in the county jail for a term not exceeding 90 days. For a third or subsequent conviction, pay a fine of not less than $1,000 and/or be imprisoned in the county jail for a term not exceeding 90 days. A separate offense shall be deemed committed each time a violation occurs.

7-10.4. 
  Right turn on red prohibition. No person shall make a right turn on a red signal into Greenleaf Plaza from eastbound Lanes Mill Road as set forth in Schedule XIX, attached to and made a part of this chapter.

The streets or parts of streets described in Schedule XVI, attached to and made a part of this chapter shall have the speed limits designated in such schedule. Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.
7-12.1. 
  Mayor's duty. The Mayor, or Deputy Mayor, in the absence of the Mayor, is hereby authorized, by regulation,[1] upon the recommendation of the Chief of Police or the Township Engineer, to order the closing of any street or portion thereof to motor vehicle traffic on any day or days, or during specified hours on any day, whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.

7-12.2. 
  Street closing for sewer installation or installation of water lines. In the event a street must be closed temporarily for sewer installation or installation of water pipes in furtherance of required improvements of a development or other land use project, signs must be put up 10 days in advance of the closing.
a. 
If the street to be closed affects access to a farm or other commercial property, then said notice must further advise the public of alternative routes to access the affected farm or commercial property by name.
Those parts and portions of streets and highways described and designated in Schedule XVII of this chapter are hereby designated as crosswalks within the meaning of the Revised Statutes of the State of New Jersey. Signs and markings to be installed in conformity with the current Manual on Uniform Traffic Control Devices for Streets and Highways and/or as authorized by the Department of Transportation.
7-12A.1. 
    Mid-block crosswalks. Those areas designated as mid-block crosswalks in Schedule XVIIA are hereby designated for that purpose. Signs and markings are to be installed in conformity with state and local regulations.
7-12A.2. 
    Older and walking impaired persons crosswalks. Pursuant to the provisions of N.J.S.A. 39:4-183.1b, the following locations described in Schedule XVIIB attached to and made a part of this chapter are hereby established as older and walking impaired persons crosswalks.
Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.
All former traffic ordinances of the Township of Howell covered in this chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
7-14.1. 
  Creation of public parking areas. There are hereby created and established in the Township of Howell pursuant to N.J.S.A. 40:60-25.1 facilities for the parking of motor vehicles on lots now or hereafter owned or rented by the Township for that purpose. The operations of all public parking lots shall be under the supervision of the Township Manager as director of the Howell Township park and ride commuter facilities.
7-14.2. 
   Permits.
a. 
Any person who desires to park a motor vehicle in a municipal lot shall purchase from the director of park and ride commuter facilities a hang tag permit which shall be hung onto the rear view mirror of each vehicle parked in a municipal parking lot in such a manner as to be clearly visible thereon. The director shall have the authority to determine the form of said permits. An applicant for such a permit may request a duplicate permit for another motor vehicle which is registered in the same name. Only one duplicate per permit is allowed. Said duplicate permit shall be distinguishable from the original permits issued by the director. The director is authorized to issue replacement permits where a permittee wished to substitute a vehicle different from the one for which the original permit was issued. In a case where a motor vehicle with a permit must be in a repair shop for any lengthy period of time, a temporary thirty-day sticker may be issued.
b. 
Fees. The fee for such a permit shall be as set forth in Chapter 139, Fees, terminating on December 31 of each year. The director is permitted under the terms of this section to adjust and weekly pro-rate fees charged for such parking permits pro-rated based on number of weeks remaining, rounded to the nearest $1 beginning first Monday in February. This provision shall not empower the director to issue permits for less than the balance of the year for which the permit is sought. The fee for the issuance of a duplicate permit and for the issuance of a replacement permit is as set forth in Chapter 139, Fees. In the case of a temporary permit to be issued to a permit holder, the fee shall be as set forth in Chapter 139, Fees.[1]

c. 
Annual renewal. Persons desiring to purchase a permit for the next ensuing calendar year may purchase same on and alter December 1 of the preceding year.
d. 
Parking meters. At such locations in municipal parking lots where the Township shall install parking meters, the charges for parking shall be as follows: $0.25 per three hours with a twenty-four-hour maximum time limit.
7-14.3. 
   Limitations.
a. 
Limitations of use. The permits to be sold by the director under the terms of this section are intended to apply to one parking space and no person shall park a motor vehicle of such size or in such a manner as to occupy more than one such parking space. Further, motor vehicles shall be parked head-in into the parking space so that the rear bumper of the vehicle abuts traffic aisles. The issuance of a duplicate permit by the director shall not entitle the permittee to park more than one vehicle in a parking facility at one time.
b. 
Application. Each person applying for a parking permit hereunder shall complete an application form to be prepared by the director which shall set forth the name, address, and driver's license number of the applicant for the motor vehicle to which the permit is to apply, including a description of each motor vehicle by year, make, model, color, and license plate number. At the time of applying for said permit, an applicant shall present to the director the current New Jersey motor vehicle registration and insurance identification card for each vehicle for which a permit is sought (vehicles must be registered to one person). A prorated refund will be granted upon approval by the Mayor and Council by way of resolution up until June 30 of the year in which the permit was obtained. No refunds will be granted for any reason after July 1.

c. 
Nontransferability. The permit stickers to be issued hereunder shall be affixed only to the motor vehicles described in the application and shall not be transferable to any other vehicle.
7-14.4. 
   Violations. Any person who parks a vehicle or who permits a vehicle to be parked in a municipal parking lot or facility in violation of the terms of this section shall be subject to a fine of not less than $10 nor more than $50 dollars in the discretion of the Municipal Court Judge. Further, all enforcement officers are hereby authorized to arrange for the towing of any such illegally parked vehicles and the owner of said vehicle shall remain liable for all towing and storage charges associated therewith.
No passing zones are hereby established and maintained along those streets or parts of streets described in Schedule XVIII attached to and made a part of this chapter, as authorized by the Department of Transportation.
The provisions of Subtitle 1, Title 39 of the Revised Statutes of New Jersey be and they are hereby made applicable to the semipublic and private roads, streets or driveways within and leading to and from the Tanglewood Development and the various traffic regulations as listed below.
7-16.1. 
  Through streets. The following streets or parts of streets are hereby designated as through streets. Stop signs shall be installed on the near right side of each intersecting and through street, except:

7-16.2.

7-16.4. 
  Violations and penalties. Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of this section or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.
The above suggested penalty form is in conformity with N.J.S.A. 39:4-203 and should be used as a uniform standard throughout the state.
Pursuant to N.J.S.A. 39:5A-1 all state motor vehicles statutes are hereby made applicable to the semipublic roadways, driveways, parking areas and other areas used for vehicular traffic on the property known as Block 54.01, Lot 5.01 more commonly known as Aldrich Plaza on Route 9 North in Howell Township.

Pursuant to the authority vested in the Township of Howell pursuant to N.J.S.A. 39:5A-1 and pursuant to a request by the WAWA Corporation, the Council hereby ordains that the subject premises, Block 129, Lots 89-92, 92.01, 93 and 94 at Route 9 and White Street in Howell Township shall have tall their semipublic or private roads, streets, driveways, and parking areas subject to Subtitle 1 of Title 39 of the Revised Statutes of New Jersey.

CJS Investment, Inc., 1415 Wyckoff Road, Suite 300, Farmingdale, NJ 07727, has filed a written consent with the Township of Howell that the provisions of Subtitle One of Title 39 of the revised statutes of New Jersey be made applicable to the semi-public roads, streets, driveways and parking lots at Cedar Glen at Howell Complex located in the Township of Howell, County of Monmouth and the following regulations shall be enforceable.
B.

The property manager for Lanes Mill Marketplace has filed a written consent with the Township of Howell requesting that the provisions of Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at the Lanes Mill Marketplace located within the Township.
B. 
The following regulations shall be enforceable in said Lanes Mill Marketplace in accordance with the afore-referenced request.

A. 
Pursuant to the authority vested in the Township of Howell pursuant to N.J.S.A. 39:5A-1 and pursuant to a request by ABH@ Howell, LLC, owner/property manager of the aforesaid subdivision, the Council hereby ordains that the subject premises, Block 177, Lots 129.01 and 130, Howell Township, shall have their semi-public or private roads, streets, driveways and parking areas subject to Subtitle 1, Title 39 of the Revised Statutes of New Jersey.
B. 
This section is contingent upon the approval of the Commissioner of the New Jersey Department of Transportation.
C. 
Traffic regulation.
(1) 
A stop sign and "no left turn" prohibition shall be installed at the exit from the Fairfield Business Park driveway, which intersects with Fairfield Road, at a point approximately 885 feet south of Bennett Road.
(2) 
At the discretion of the municipality, current signage may be removed and replaced by signs conforming to the current Manual of Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27, said signs to be installed and paid for by the owner/applicant.
(3) 
Unless another penalty is expressly provided for by the New Jersey Statutes, every person convicted of a violation of this section or any amendment thereto shall be liable for a penalty of not more than $500 or imprisonment for a term not to exceed 15 days, or both.

Pursuant to the authority vested in the Township of Howell pursuant to N.J.S.A. 39:5A-1 and pursuant to a request by Board of Trustees for the Villages Association, all state motor vehicles statutes are hereby made applicable to the roadways, driveways, parking areas and other areas used for vehicular traffic on the property known as "The Villages."
