The Board of Trustees, hereby finds that:
A.Â
The use of tobacco products, including cigarettes, as
determined by the United States Surgeon General, may be harmful to the health
and comfort of the user and the nonuser of such products.
B.Â
Many smokers acquire the habit of using tobacco products
as minors, prior to the age of legal consent.
C.Â
The distribution of cigarettes and other tobacco products
to members of the general public for free or at only a nominal charge encourages
the use of tobacco products by minors and is detrimental to the public health.
D.Â
The use of vending machines to dispense tobacco products
facilitates the availability of such products to minors and encourages the
use of such products by minors and is therefore detrimental to the public
health.
As used in this chapter, the following terms shall have the meanings
indicated:
Any price less than the cost to the distributor, plus the amount
of any taxes not included in such costs.
A person, firm, company, corporation, partnership, sole proprietor,
limited partnership or association.
Cigarettes, cigars, chewing tobacco, powdered tobacco or any other
tobacco products.

No person in the Village shall operate or permit on its
premises the placement or operation of a vending machine which dispenses cigarettes
or tobacco products, except that any person who now has such a vending machine
on his/her premises shall have 60 days after the effective date of this chapter
to remove said machine.
B.Â
No cigarette or other tobacco product may be sold, offered
for sale or distributed in the Village by or from a vending machine or any
other device designed or used for vending purposes.
C.Â
No person engaged in the business of selling or otherwise
distributing cigarettes or tobacco products or any agent or employee of such
person shall, in furtherance of such business, distribute without charge or
for a nominal cost any cigarettes or tobacco products to any individual within
the Village at any time.
The provisions of this chapter shall be enforced by the Village's
code enforcement officers, and they are hereby given the power and authority
to do so.
A.Â
Each violation of this chapter shall be punishable by
a fine not to exceed $250 or by imprisonment for a period not to exceed 15
days, or both.
B.Â
Each day on which a vending machine prohibited by this
chapter remains or is operated on a premises within the Village shall constitute
a separate violation of this chapter.
