Unless the same is enclosed in a garage or other building, it shall be unlawful for the owner, occupant, lessee, agent, tenant or otherwise of any property within a residential zone to have or permit anyone to have on such property any unregistered motor vehicle or motor vehicle with an expired registration in excess of three months; provided, however, that this provision shall not apply to not more than one such vehicle on such property that is actually being restored, repaired or maintained in such operating condition as would permit it to be lawfully operated upon the public roadways if currently registered.
Unless the same is enclosed in a garage or other building, it shall be unlawful for the owner of any property outside of a residential zone to have or permit anyone to have on such property any unregistered motor vehicle or motor vehicle with an expired registration in excess of seven days; provided, however, that the provision shall not apply to any vehicle being offered for sale by any licensed automobile dealer or used car lot.
If the provisions of § 157-1 or 157-2 are violated, the Town Clerk shall serve written notice, either personally or by certified mail, return receipt requested, and regular mail, upon the owner, occupant, lessee, agent, tenant or person having charge of any such land to comply with the provisions of this chapter. The notice shall be in substantially the following form:
To the owner, occupant, lessee, agent, tenant or person having charge of land known on the Assessment Map of the Town of Haverstraw as Lot(s) _______________ Number(s) ____________, Street ___________________, Block ______ or Number _____________, Street or Avenue.
Notice is hereby given that an abandoned, junked, discarded and unlicensed motor vehicle has been found stored or deposited upon the above-described property in the Town of Haverstraw. This automobile must be removed within seven days from the date of this notice.
In case you fail or refuse to comply with this notice on or before the expiration of said seven days from the date of this notice, the Town of Haverstraw, acting through its duly authorized agents, servants, officers and employees, will enter upon your land and remove and cause the same to be destroyed. The expense incurred by the Town will be assessed against the above-described land and shall constitute a lien thereon and be collected as provided by law.
Any owner, occupant, lessee, agent or tenant who shall neglect and refuse to remove such abandoned, junked, discarded or other motor vehicle not properly licensed and registered as directed by this chapter or who shall fail or refuse to comply with the provisions of any notice herein provided for or who shall violate any of the provisions of this chapter or who shall resist or obstruct the duly authorized agents, servants, officers and employees of the Town in the removal and destruction thereof shall be punishable, upon conviction, by a fine of not more than $500 or imprisonment for a period not exceeding 15 days, or both.
