§ 158-34 Penalties for offenses.

A. Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law shall, for a first conviction thereof, be punished by a fine of not more than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $200 or by imprisonment for not more than 45 days. or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $300 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.

B. Any violation by a person, firm or corporation of this chapter, other than a traffic infraction, shall be deemed an offense punishable by a fine not to exceed $250 or imprisonment for a period not to exceed 15 days, or both.

C. Every person convicted of any of the following parking violations shall receive the following penalties:

(1) Fire zone: $100.

(2) Handicap: $100.

(3) Blocking driveway: $50.

(4) Parked within 15 feet of fire hydrant: $50.

(5) Double-parked vehicle: $50.

(6) All other: $50.

D. In the case of continuing violation of this chapter, each day that such violation exists shall constitute a separate and distinct violation.
