[HISTORY: Adopted the Township Committee
of the Township of Hazlet 3-16-1982 by Ord. No. 555-82 as Sec. 6-9 of the
1982 Revised General Ordinances (Ch. 229 of the 1993 Code; amended
in its entirety at the time of adoption of Code; see Ch. 1, General
Provisions, Art. I). Subsequent amendments noted where applicable.]
A retailer will not display or permit to be displayed at his
business premises any obscene material, as defined in N.J.S.A. 2C:34-3,
at a height of less than five feet or without a blinder or other covering
placed or printed on the front of the material displayed.
Public display of any obscene material shall constitute presumptive
evidence that the retailer knowingly made or permitted the display.
