A. 
A permit shall be obtained for the parking, standing or locating of any truck, wagon, cart or other mobile unit designed or intended to be used for the sale of food or merchandise:
(1) 
Upon any of the lands owned by the Township or any of its agencies, including the Board of Education, and utilized for public, municipal, educational or recreational purposes.
(2) 
Within 1,000 feet of any lands owned by the Township or any of its agencies, including the Board of Education, and designed for public, municipal, educational or recreational purposes, whether upon a public street or otherwise.
B. 
Furthermore, in conjunction with said permit, food vending vehicles shall not be permitted to remain at any site for the purposes of preparing and vending foods for more than 30 minutes and may not relocate to a site within 1,000 yards of the previous site. However, this section shall not apply if the vendor has received written permission to locate a vehicle at a specific site pursuant to § 325-9.

C. 
Any food vendor who is looking to remain at one stationary location (example: parking lots) shall obtain site plan approval from the applicable board who has jurisdiction to grant such.

The parking, standing or locating of any such truck, wagon, cart or other mobile unit, shall not be deemed to be a violation of this article, provided that the owner or owners of the truck, wagon, cart or other mobile unit shall have been requested to so park, stand or locate such truck, wagon, cart or other mobile unit by any of the agencies, commissions or officers of the Township or the Board of Education. Such parking, standing or locating of any truck, wagon, cart or other mobile unit shall be limited to servicing of any public, charitable, recreational, sports or other similar activity. The owner or operator of any such truck, wagon, cart or other mobile unit shall first apply to the Chief of Police of the Township for written permission therefor.
The Chief of Police shall issue written permission for the parking, standing or locating of any such truck, wagon, cart or other mobile unit upon being satisfied that written request therefor has been received and approved by an agency, commission or officer of the Township or the Board of Education and that the number and location of any such trucks, wagons, carts or other mobile units will not constitute a danger to the public health, safety or welfare in terms of numbers, location or period of time so parked, standing or located.

For violation of any provision of this article, the maximum penalty, upon conviction, shall not exceed the maximum penalties set forth in Chapter 1, General Provisions, Article III. Each and every violation of any provision of this article shall be considered a separate violation and shall subject the person so charged to the maximum penalty.
